我国食品安全中的惩罚性赔偿制度研究

【摘要】：民以食为天,食以安为先。近年来,我国食品安全领域的违法违规事件频发,对于食品安全领域的司法改革刻不容缓。设立惩罚性赔偿制度对于食品安全领域内混乱的侵权事件可以起到一定的遏制和缓解的作用。通篇分为五大章节,将从惩罚性赔偿制度的设立、发展历史、在司法实践中存在的问题以及问题的解决和制度的完善等方面对惩罚性赔偿制度由浅入深形成一个明晰的认识和了解,对于我国食品安全中惩罚性赔偿制度的适用提出更好更加完善的建议。第一部分为绪论,在这一部分中主要对各国的惩罚赔偿制度的发展及学界的看法进行了理论整合和罗列,对不同法系的理论基础进行了简单地了解和认识。第二部分为食品安全中惩罚性赔偿制度的基本问题,主要是从制度的概念、功能到构成要件都进行了详细的描述,对惩罚性赔偿制度有了一个全面的认识。从最基础的部分对惩罚性赔偿制度的概念进行明确的认识。第三部分是对我国司法实践中有关惩罚性赔偿制度的立法现状进行了详细的阐释和罗列。在这一部分中将有关惩罚性赔偿制度的法律条文进行了详细的说明,并且指出我国目前司法实践在运用惩罚性赔偿制度时出现的各种各样的问题。第四部分是对惩罚性赔偿制度的域外考察,从英美法系、大陆法系以及我国台湾地区法学界对惩罚性赔偿制度的逐渐接受到立法的确认这一系列的变化发展,对不同法系、不同国家的惩罚性赔偿制度进行比较和分析,以期待在相互比较、相互了解的过程中得出最适合我国司法适用的有关惩罚性赔偿制度的启示。在全文的最后,针对我国惩罚性赔偿制度在司法实践中存在的问题提出相对应的建议,主要是从完善法律规定的主体范围、合理分配举证责任以及相关制度的完善这三方面着手,对制度中存在的不足和缺陷逐一列明,并根据实践中出现的问题设计解决方案,提出了自己的见解,希望通过这篇文章的写作能够提高自己运用法律思维解决问题的能力。
[Abstract]:In recent years, there have been frequent violations of laws and regulations in the field of food safety in China. It is urgent for the judicial reform in the field of food safety. The establishment of the punitive damages system can play a certain role in containing and alleviating the chaotic tort incidents in the field of food safety. The whole article is divided into five chapters. It will form a clear understanding and understanding of the punitive damages system from the aspects of the establishment of punitive damages system, the history of development, the problems existing in judicial practice, the solution of the problems and the perfection of the system, etc. The first part is the introduction, in which the development of punitive compensation system in various countries and the views of academic circles are theoretically integrated and listed. The second part is the basic problems of punitive damages system in food safety, mainly from the concept of the system, function to the elements are described in detail. There is a comprehensive understanding of the punitive damages system. The concept of punitive damages system is clearly understood from the most basic part. The third part is the legislation of punitive damages system in the judicial practice of our country. In this part, the legal provisions relating to the punitive damages system are explained in detail. It also points out that there are various problems in the application of punitive damages system in the judicial practice of our country at present. 4th part is the extraterritorial investigation of punitive damages system, from the Anglo-American legal system, The gradual acceptance of the punitive damages system in the civil law system and the legal circles in Taiwan region is a series of changes and developments, and a comparison and analysis of the punitive damages system in different legal systems and countries is carried out. In the process of mutual comparison and mutual understanding, the author hopes to draw inspiration from the system of punitive damages, which is most suitable for the judicial application of our country. At the end of this paper, In view of the problems existing in the judicial practice of the punitive damages system in our country, the corresponding suggestions are put forward, mainly from the following three aspects: perfecting the scope of the subject stipulated by the law, rationally distributing the burden of proof and perfecting the relevant system. This paper lists the shortcomings and defects in the system one by one, designs the solutions according to the problems in practice, and puts forward his own opinions, hoping that through the writing of this article, he can improve his ability to solve the problems by using legal thinking.
