国家南繁育制种立法与法规体系框架构建研究

【摘要】：国家南繁育制种正面临生态安全、种业安全、发展不对称、建设滞后以及政策法律化等系列问题。南繁作为国家战略性资源,其组织管理缺乏政策法制支撑,导致南繁管理体制与协调机制不能适应和满足南繁发展的需要。将南繁法规体系构建研究置于农业法制建设和科技法制建设的基础上,从南繁育制种科研生产活动、南繁管理体系、南繁行政执法体系、南繁产业发展、地方法制建设等角度,通过对南繁相关法律法规规章的判断、对南繁相关标准的评估,提出以南繁科学可持续发展为目标的南繁法规体系框架。目前,构建南繁法规体系有较好的政策和法律基础,已具备可接受性、可实行性和易遵守性;南繁法规体系具有产业性、科技性、国家干预性、服务性和法群性,具有三级结构。南繁法规体系可为国家干预、南繁制度化建设和法治化管理提供支撑和保障,以实现南繁和谐的利益格局与秩序,确保南繁用地红线。
[Abstract]:The national south breeding and seed production is facing a series of problems, such as ecological security, seed industry safety, asymmetric development, lagging construction and legalization of policy. As a national strategic resource, its organization and management lack the support of policy and legal system. As a result, the management system and coordination mechanism of South Propagation can not meet the needs of the development of Nanfan. Based on the construction of agricultural legal system and the construction of S & T legal system, the scientific research and production activities of seed production in Southern Propagation and breeding are put forward. Nanfan management system, Nanfan administrative law enforcement system, Nanfan industry development, local legal system construction and other angles, through the judgment of Nanfan related laws and regulations, the evaluation of Nanfan related standards, At present, it has a good policy and legal foundation to construct the legal system of South Propagation, which has been accepted, implemented and obeyed easily. The legal system of Nanfan has the characteristics of industry, science and technology, national intervention, service and law group, and has a three-level structure. The legal system of Nanfan can provide support and guarantee for the state intervention, the systematization of Nanfan and the management of ruling by law. In order to achieve a harmonious interest pattern and order, ensure the red line of Nanfan land.
