基层治理法治化的逻辑构成与结构范畴研究

【摘要】：推进农村基层治理法治化是农村现代化进程中基层治理变革的主要方向,也是实现农村基层治理体系和治理能力现代化的重要标志。法治化改变的是传统的基层治理理念,创造的是全新的基层治理思维,关注的是构建农村基层规范的治理秩序和稳定的治理格局。推进基层治理法治化能够很好地将现代法治的理念、思维、结构和制度凝聚到基层治理的整体框架中来,将法治的治理模式植入到基层治理的各个环节之中,能够在农村构建起法治化的基层治理规则,能够真正实现基层治理现代化的宏观愿景与整体目标。基层治理法治化体系具有鲜明的治理要素与法治元素,具有自身独特的逻辑构成和结构范畴。
[Abstract]:Promoting the rule of law in rural grassroots governance is the main direction of grass-roots governance reform in the process of rural modernization, and it is also an important symbol to realize the modernization of rural grass-roots governance system and governance ability. What is created is a brand new grass-roots governance thinking, which focuses on the construction of a rural grass-roots normative governance order and a stable governance pattern. Advancing the grass-roots governance by law can make the modern concept and thinking of the rule of law very good. The structure and system are condensed into the overall framework of grass-roots governance, and the governance model of the rule of law is implanted into every link of grass-roots governance, which can construct the rule of law in rural areas. It can truly realize the macro vision and the overall goal of the modernization of grass-roots governance, and the system of rule of law at the grass-roots level has distinct elements of governance and rule of law, and has its own unique logical composition and structural category.
