论自媒体时代艺术自由的法律保护与规制

【摘要】：我国法律认为艺术自由是指艺术活动中的创作自由和表现自由。我们国家通过宪法、法律、行政法规、部门规章等一系列法律法规来进行对艺术自由的保护和规制。一方面,我们国家确定了艺术自由的权利存在,建立了对其的保护机制,界定了其权利边界,保障其生产秩序,并为艺术自由创建安全的环境;另一方面,我们国家也从内容、时间、地点、方式、对象、传播媒介等方面对艺术自由进行事先限制和事后惩罚。总的来说,这些法律规定在消除权利冲突、创建安全网络环境等方面取得了一定成绩,但是在保护机制运作、内容限制不透明和"一刀切"等方面也有不足。而自媒体时代所具有的主体广泛、平台开放、信息及时、交流互动强、时空无限、表达多样等特点,在现有立法层面和法律实践中又对艺术自由的行使提出了新的挑战:对个人艺术自由的保护和规制缺失,事先审查制度难以操作,艺术表达传播速度和范围难以控制,司法救济无效等等。为了应对自媒体时代对艺术自由提出的新挑战,应在立法、执法、司法、行业自律等各个环节建立一套相辅相成的法律制度,从而达成让我国艺术自由的保护与规制更加完善、更适应新时代发展的目标。
[Abstract]:The law of our country regards the freedom of art as the freedom of creation and expression in artistic activities. Our country protects and regulates the freedom of art through a series of laws and regulations, such as constitution, laws, administrative regulations, departmental regulations, etc. On the one hand, Our country has established the existence of the right to artistic freedom, established mechanisms for its protection, defined its boundaries of rights, guaranteed its production order, and created a secure environment for artistic freedom; on the other hand, our country has also looked at content, time, Places, ways, objects, media and other aspects of artistic freedom are restricted in advance and punished afterwards. Generally speaking, these laws and regulations have made some achievements in eliminating conflicts of rights and creating a secure network environment. However, there are also shortcomings in the operation of the protection mechanism, opacity of content restriction and "one-size-fits-all". Since the media age, the main body is extensive, the platform is open, the information is timely, the exchange is strong, the interaction is strong, the time and space is infinite, the expression is diverse and so on. In the current legislative level and in the legal practice, it puts forward new challenges to the exercise of artistic freedom: the lack of protection and regulation of individual artistic freedom, the difficulty of operation of prior censorship system, and the difficulty of controlling the speed and scope of artistic expression dissemination. In order to meet the new challenges to artistic freedom put forward by the media era, we should establish a complementary legal system in all aspects of legislation, law enforcement, justice, industry self-discipline, and so on. In order to achieve the protection and regulation of artistic freedom in China more perfect, more suitable for the development of the new era.
