海东市农村土地执法监管研究

【摘要】：十分珍惜资源，，合理利用土地，切实保护耕地，促进社会经济的可持续发展已是当今社会的重要课题。随着城镇化建设和新农村建设的不断深化，建设用地需求急剧增长，保护耕地与保障发展的矛盾十分尖锐，地方政府和基层国土资源管理部门面临的土地监管任务也异常繁重。近年来由于保护耕地红线的政策不断趋紧张，土地供需矛盾将日益凸显，违法用地反弹的压力很大。作为身处土地保护前沿的基层国土资源管理部门，如何找准保护耕地与保障发展的最佳结合点，创新查处土地执法监管的工作机制，是城镇化建设和新农村建设的重要保障。农村土地执法监管难的问题一直是地方政府和基层国土资源管理部门的“老大难”问题。农村土地执法监管难的问题表现为发现难、查处难和执行难。造成执法难的原因既有体制上的原因，也有法律上的原因，还有人员素质上的原因。本文通过分析海东市农村土地违法行为现状和土地执法监管现状，总结出海东市国土资源管理部门在农村土地执法监管中存在的问题，提出解决问题的对策，探索如何建立农村土地执法监管新机制。
[Abstract]:It is an important task to treasure resources, make rational use of land, protect cultivated land and promote the sustainable development of social economy.With the continuous deepening of urbanization and new rural construction, the demand for construction land has increased sharply, the contradiction between protecting cultivated land and ensuring development is very sharp, and the task of land supervision faced by local governments and grass-roots land and resources management departments is also extremely heavy.In recent years, as the policy of protecting the red line of cultivated land becomes more and more tense, the contradiction between supply and demand of land will become more and more prominent, and the pressure of illegal land rebounding will be great.As a grass-roots land and resource management department in the forefront of land protection, how to find the best combination of protecting cultivated land and ensuring development, and how to innovate the working mechanism of land law enforcement and supervision is an important guarantee for the construction of urbanization and the construction of new countryside.The problem of the rural land law enforcement and supervision is always the old problem of the local government and the basic land resources management department.The problems of rural land law enforcement and supervision are difficult to find, investigate and execute.The reasons for the difficulty in law enforcement are not only institutional, legal, but also personnel quality.Based on the analysis of the current situation of the illegal behavior of rural land and the present situation of land law enforcement and supervision in Haidong City, this paper summarizes the problems existing in the rural land law enforcement and supervision by the land and resources management department of Haidong City, and puts forward some countermeasures to solve the problems.Explore how to establish a new mechanism of rural land law enforcement and supervision.
