【摘要】：矿产资源的开采为国家的繁荣、经济的发展、社会进步提供强大的动力，从人类对其进行开发利用之日起，就成为人类赖以生存和发展的必要条件。纵观我国《矿产资源法》的现状及实施，，在不断的改进中已经有很大进步，但仍存在秩序混乱、环境破坏、矿难频发等弊病却依然是我们不得不面对的事实。这些问题的背后是各种利益的碰撞、博弈。所以，现阶段加强矿业管理对于矿业市场经济活动有着十分重要的影响。矿业权登记制度作为矿业管理中的基础和重要组成部分，不但有助于确认和保护矿业权交易，避免浪费交易成本，而且可以保护矿业权的交易安全，促进矿业经济的和谐平稳发展。但是我国现行矿业权登记在立法方面十分分散，在具体的实践操作中又没有明确的登记制度。所以通过对矿业权基本登记制度研究，对于维护安定有序的矿业权市场秩序具有十分重要的意义。如何完善我国矿业权登记制度是本文主要探讨和解决的。首先就应该对矿业权登记制度的基本理论有一个整体的了解，从矿业权登记的类型到其主要内容（主要包括矿业权登记机关、登记范围、登记簿、登记程序、登记效力）再到通过确定矿业权登记制度对矿业市场的发展意义来进行介绍和分析。第二，因为矿业权登记制度更多的具有专业性和技术性的特征，所以对其他一些国家和地区先进矿业权登记制度体系的借鉴，既十分必要，也较为可行。最后，从立法和具体制度两个层面分析我国矿业权登记存在的主要问题及完善措施：在立法层面，要明确矿业权登记的法律依据，完善相关法律规定；在具体制度方面，应该将矿业管理机关按各自职能独立开来，将矿产物权证和矿业许可证区别开来，明确登记效力，增加他项权登记制度。在文章的论述过程中，主要围绕我国矿业权登记的现状及实践操作中存在的问题，通过理论与实践相结合的手法，来寻求解决问题的途径，结合我国国情，建立符合现实需要的矿业权登记制度。
[Abstract]:Throughout the present situation and implementation of mineral resources law in our country, great progress has been made in the continuous improvement, but there are still some disadvantages, such as disorder of order, environmental damage and frequent mine disasters, which we still have to face.Behind these problems is the collision of various interests, the game.Therefore, the present stage strengthens the mining management to the mining market economy activity has the very important influence.As the foundation and important part of mining management, mining right registration system can not only help to confirm and protect mining right trading, avoid wasting transaction cost, but also protect the safety of mining right transaction.Promote the harmonious and stable development of mining economy.However, the current mining right registration in our country is very scattered in legislation, and there is no clear registration system in concrete practice.Therefore, it is of great significance to maintain a stable and orderly mining rights market order by studying the basic registration system of mining rights.How to perfect our country mining right registration system is mainly discussed and solved in this paper.First of all, we should have an overall understanding of the basic theory of the mining rights registration system, from the types of mining rights registration to its main contents (mainly including mining rights registration authorities, registration scope, registration books, registration procedures, etc.)Then it introduces and analyzes the significance of mining right registration system to the development of mining market.Second, because the mining rights registration system has more professional and technical characteristics, it is necessary and feasible to learn from the advanced mining rights registration system in other countries and regions.Finally, from the legislation and the specific system two aspects analysis our country mining right registration existence main question and the consummation measure: in the legislative level, must clear the mining right registration the legal basis, consummates the related law stipulation; in the concrete system aspect,In the process of discussion, the paper mainly focuses on the present situation of mining right registration and the problems existing in practice, through the combination of theory and practice, to find a way to solve the problem, combined with the situation of our country.To establish a mining rights registration system in line with the actual needs.
