广州市流动商贩管理文明执法问题研究

【摘要】：随着城市化进程的不断深入，大量外来人员和失地农民涌入城市，城市流动商贩的出现无可避免，而且流动商贩的数量逐年增加。大量流动商贩的存在影响了社会正常的交通、经济秩序，破坏了市容市貌和卫生环境，同时给城市管理工作带来了困扰。流动商贩的管理一直以来都是广州城市管理的难题。广州以前对流动商贩的管理都是以粗暴，简约的没收、罚款等刚性手段为主，属于刚性管理，暴力事件不时发生。从2009年开始，广州城市管理工作提倡文明执法，一切依法行政，执法手段和方法得当，尽量让流动商贩，群众和社会都认可执法工作，力图创建一种和谐文明的管理氛围。但是文明执法实行几年以来，工作思路仍不清晰，在实施的过程中遇到许多困难，难以展开，在实际的工作中也未能取得预期的效果。本文试图以柔性管理理论为基础，，论述广州城市管理引入柔性管理的作用与可行性。通过参考国内外城市管理中柔性管理的先进做法，结合广州本地的实际情况，将柔性管理更有效的融入文明执法当中，提出具体的柔性社会管理措施，为文明执法指明工作思路和具体工作方法，让文明执法能够有效展开，使广州流动商贩管理工作得到质的提升。本文首先运用文献研究法，搜集文明执法的文献，整理分析之前的研究成果和有效的管理方法。其次采用访谈法对城管执法队员进行访谈，了解他们对流动商贩管理文明执法的认识，以及存在的问题。然后用柔性社会管理理论对文明执法进行指导和补充，分析流动商贩文明执法存在的问题：在执法主体上存在管理观念传统，部分执法队员消极执法的问题，同时受到执法环境中可依据的法律法规和执法保障不足，执法程序上“三难”现象突出，执法冲突难以避免，流动商贩乱摆卖的年轻化、集团化、机械化、暴力化、企业化、市中心化趋势带来的挑战，城管形象妖魔化，对少数民族管理力不从心等客观原因的制约。并进行原因分析：执法人员准入制度和培训体系不完善，执法观念存在偏差，立法滞后，政府引导不足，缺乏监督体制，政府对文明执法宣传不足。提出改进措施：规范执法方式，深化文明执法理念，提高执法队伍的整体素质，建立人员准入制度和培训体系，完善立法，健全文明执法的制度，加强执法监督和责任追究，加大宣传力度，给流动商贩提供合法经营场所。
[Abstract]:With the deepening of the urbanization process, a large number of foreign workers and landless farmers poured into the city, the emergence of mobile traders in the city is inevitable, and the number of mobile traders is increasing year by year.The existence of a large number of mobile traders has affected the normal traffic and economic order of the society, destroyed the appearance of the city and the sanitary environment, and at the same time brought troubles to the urban management.The management of mobile vendors has always been a difficult problem in Guangzhou city management.The management of mobile vendors in Guangzhou used to be rough, simple confiscation, fines and other rigid means, belong to rigid management, violent incidents occur from time to time.Since 2009, Guangzhou urban management has advocated civilized law enforcement, all administration according to law, proper law enforcement means and methods, as far as possible, let mobile traders, the masses and the society recognize law enforcement work, and strive to create a harmonious and civilized management atmosphere.However, since the implementation of civilized law enforcement for several years, the working ideas are still unclear, encountered many difficulties in the process of implementation, difficult to carry out, and failed to achieve the expected results in the actual work.Based on the theory of flexible management, this paper discusses the function and feasibility of introducing flexible management into Guangzhou city management.By referring to the advanced practices of flexible management in urban management at home and abroad and combining with the actual situation in Guangzhou, flexible management is more effectively integrated into civilized law enforcement, and concrete flexible social management measures are put forward.To point out the working idea and concrete working method for civilized law enforcement, to make civilized law enforcement to be carried out effectively, and to improve the quality of Guangzhou floating traders management work.In this paper, literature research method is first used to collect the documents of civilized law enforcement, and the previous research results and effective management methods are analyzed.Secondly, interview the law enforcement members of urban management to understand their understanding of the management of mobile vendors civilized law enforcement, as well as the existing problems.Then we use the flexible social management theory to guide and supplement the civilized law enforcement, and analyze the problems existing in the floating traders' civilized law enforcement: there is a tradition of management concept on the subject of law enforcement, and some law enforcement members have the problem of passive law enforcement.At the same time, the laws and regulations that can be relied upon in the law enforcement environment and the law enforcement protection are insufficient, the phenomenon of "three difficulties" in the law enforcement procedures is prominent, the conflict of law enforcement is difficult to avoid, and the mobile traders are becoming younger, more organized, more mechanized, more violent, and more enterprise-oriented.The challenge brought by the trend of the city center and the demonization of the image of urban management restrict the management of minority nationalities.The reasons are as follows: the entry system and training system of law enforcement personnel are not perfect, the concept of law enforcement is biased, the legislation lags behind, the government guidance is insufficient, the government lacks the supervision system, and the government does not propagate the civilized law enforcement.Some improvement measures are put forward: standardizing the law enforcement way, deepening the civilized law enforcement idea, improving the overall quality of the law enforcement team, establishing the personnel access system and training system, perfecting the legislation, perfecting the civilized law enforcement system, strengthening the law enforcement supervision and responsibility investigation.Increase publicity efforts, to mobile vendors to provide legal business sites.
