【摘要】：食品安全问题关乎民生福祉、经济发展、社会和谐、国家形象,已经成为了当今国际社会普遍关注的重大问题。近年来我国的食品安全问题频发不断地打击消费者对我国食品市场的信心。食品安全信息追溯制度作为一项重要的食品安全监管制度,通过采用信息化手段保证各环节责任主体的相关制度贯彻落实,为食品安全问题的追责提供法律依据。在当今的信息化时代,完善食品安全信息追溯制度有利于动态的网络数据库的信息化和制度化,不仅确保在食品技术层面有法律保障,也为未来的食品安全事故责任追究提供了准确、完备的证据基础。本文梳理了食品安全信息追溯制度的相关概念,从食品安全信息追溯制度的内涵出发,分析了我国食品安全追溯制度的适用现状,以乳制品生产企业的该制度落实为典范分析了行业内部建设食品安全信息追溯系统的管理经验,并总结出了我国适用食品安全信息追溯制度时从法律规范到追责机制等在内的诸多缺陷。本文对比了美国、日本、欧盟等国在适用食品安全信息追溯制度的不同法律规范和具体做法,借鉴了有关标识管理规范、机构建设、和追责机制等方面的经验,提出了具有针对性的完善建议。本文的创新点在于以我国乳制品生产企业的行业管理经验为典范,构想出了农村初级农产品供销追溯系统。针对目前我国食品生产加工小作坊、小摊贩的信息追溯法律规制的空缺提出了合理化建议。
[Abstract]:Food safety concerns people's well-being, economic development, social harmony, national image, has become a major concern of the international community. In recent years, China's food safety problems frequently attack consumer confidence in China's food market. Food safety information traceability system as an important food safety supervision system, through the use of information technology means to ensure the implementation of the relevant system of the main responsibility of each link, to provide a legal basis for food safety issues. In today's information age, perfecting the food safety information traceability system is conducive to the informatization and institutionalization of the dynamic network database, and not only ensures that there is legal protection at the food technology level, It also provides an accurate and complete evidence basis for the future investigation of food safety accidents. This paper combs the related concepts of food safety information traceability system, and analyzes the current situation of food safety traceability system in our country from the connotation of food safety information traceability system. Taking the implementation of this system in dairy production enterprises as a model, this paper analyzes the management experience of constructing food safety information traceability system within the industry. And summed up the application of food safety information traceability system, from legal norms to accountability mechanism and so on. This paper compares the different legal norms and specific practices of the food safety information traceability system in the United States, Japan, the European Union and other countries, and draws on the experience of the marking management norms, the institution building, and the accountability mechanism, etc. Some suggestions are put forward. The innovation of this paper is based on the industry management experience of dairy production enterprises in our country, and a rural primary agricultural product supply and marketing traceability system is conceived. This paper puts forward some reasonable suggestions on the information traceability of small food processing workshops and vendors in our country.
