城市管理非强制执法行为法治化研究

【摘要】:城市经济水平的飞速发展,城市化进程不断加快,城市的周边群众源源不断地被吸引到城市中来,城市人口急剧增长,导致城市治理的压力越来越大,城市管理行政执法应运而生。经过将近二十年的努力,城市管理行政执法在促进城市的综合治理和建设法治政府的理念上起到了重要的作用。但是,在取得成效的同时社会群众发出了对城管不满的声音,甚至的有的群众主张撤销城市管理行政执法。出现此声音的根源在于城管维护城市发展秩序以及与街头设摊人员谋生计权利之间存在尖锐矛盾,导致矛盾愈发激烈的直接原因在于城管在街头野蛮、暴力的执法方式。因此,现实困境迫使城市管理行政执法方式亟需改革。为缓和两者之间的矛盾,城市管理行政执法机关在相对集中行政处罚权领域进行了非强制执法方式的探索,经过实践的检验,非强制执法方式的运用对城市管理行政执法领域矛盾缓和,执法效率都起到了积极的作用,但是不可避免的是因为缺乏对非强制性执法方式法治化研究,权力的行使造成权利的损害也时有发生。文章第一部分从城市管理非强制执法行为的基本含义着手,首先,从平衡论、公众参与理论、经济人假设理论三个角度叙述推行城市管理非强制执法行为的理论基础。其次,介绍了城市管理非强制执法行为的四个基本主要方式,主要包括建议类方式、合意解纷方式、契约类方式、给付类方式。最后,分析了非强制执法行为对城市管理行政执法带来的积极意义。文章第二部分论述在城市管理行政执法中非强制执法行为的实践形态,通过分析其在城市管理行政执法中的运行状况,为城市管理非强制执法行为的法治化提供实践基础。文章第三部分,阐述城市管理行政执法过程中,非强制执法行为在运行中出现的问题,以及带来的后果为城市管理非强制执法方式法治化提供了研究方向。文章第四部分是探索城市管理非强制执法法治化的路径。首先,从宏观方面论述非强制执法行为应当为非强制执法行为设置法律保障、法治化过程中应当平衡公权力和私权利、法治化应当全面要求为非强制执法方式法治化提供了基本方向。其次,从微观角度,以执法依据、执法程序、执法责任、执法救济探索四种基本方式法治化路径。
[Abstract]:With the rapid development of urban economy and the acceleration of urbanization process, the surrounding masses of the city are continuously attracted to the city, and the rapid growth of the urban population leads to more and more pressure of urban governance. Administrative law enforcement of urban management emerged as the times require. After nearly 20 years of efforts, urban administration and law enforcement has played an important role in promoting the comprehensive management of cities and building the concept of government ruled by law. However, at the same time, the social masses issued a voice of dissatisfaction with urban management, even some people advocated the abolition of administrative law enforcement of urban management. The root of this voice lies in the sharp contradiction between chengguan's maintenance of urban development order and their right to earn a living in street stalls. The direct reason for the increasingly fierce contradiction lies in the brutal and violent way of law enforcement by chengguan in the street. Therefore, the reality difficult situation compels the city management administration law enforcement way to need the reform urgently. In order to ease the contradiction between the two, the administrative law enforcement agencies of urban management have explored the non-compulsory law enforcement methods in the field of relatively centralized administrative punishment power, and have been tested by practice. The use of non-compulsory law enforcement methods has played a positive role in easing the contradictions in the field of administrative law enforcement in urban management and in the efficiency of law enforcement, but it is inevitable that there is a lack of research on the legalization of non-mandatory law enforcement methods. The exercise of power causes damage to the right from time to time. The first part of the article starts with the basic meaning of non-compulsory law enforcement in urban management. First of all, it narrates the theoretical basis of carrying out non-compulsory law enforcement in urban management from three angles: balance theory, public participation theory and economic man hypothesis theory. Secondly, it introduces four basic ways of non-compulsory law enforcement in urban management, including suggestion, consensual solution, contract and payment. Finally, it analyzes the positive significance of non-compulsory law enforcement to urban administrative law enforcement. The second part of the article discusses the practice form of non-compulsory law enforcement in urban administrative law enforcement, and provides a practical basis for the legalization of urban management non-compulsory law enforcement by analyzing its operation in urban administrative law enforcement. The third part of the article expounds the problems in the operation of non-compulsory law enforcement in the process of urban management administrative law enforcement and the consequences which provide the research direction for the legalization of urban management non-compulsory law enforcement. The fourth part is to explore the path of non-compulsory law enforcement in urban management. First of all, from the macro point of view, the non-compulsory law enforcement should be provided with legal protection, and the public and private rights should be balanced in the process of ruling by law. The rule of law should provide a basic direction for non-compulsory law enforcement. Secondly, from the micro point of view, it explores four basic ways to rule by law, such as law enforcement basis, law enforcement procedure, law enforcement responsibility and law enforcement relief.
