论食品安全监管的政府责任

【摘要】:我国近年来食品安全事件无论是从时间还是空间上,无论是从发生频率还是辐射范围,都是以往数十年无法超越的。食品安全事故频发不仅对广大消费者的个人及家庭健康造成许多可逆转或不可逆转的损害,也对国家食品产业造成了极其不良的后果,更甚至于,食品安全事件的监管疏漏责任直指政府,公众对政府的不信任与日俱增,严重影响了政府公信力。在食品安全监管中,政府作为公共利益的保护者,公众信赖的监管者,市场运行的调控者,责任不可谓不重大。本文综合应用语义分析、比较分析以及实证分析等研究方法,从行政法和经济法的角度,提出问题,分析问题,与发达国家横向比较,诠释法理,最终讨论得到食品安全政府监管责任的缺失及对策。在陈述我国现阶段食品安全的监管现状,并分析政府责任的缺失,参考发达国家(日、美)的监管经验后,最终得出三点对策。其一是完善政府立法责任。完善食品安全监管法律法规、监管预防体系、相关标准,加速推行食品信息追溯制度、食品召回制度与HACCP制度。其二是完善政府执法责任。提高政府、监管部门的监管意识与执法力度,提高食品安全检测的科学技术水平,落实食品安全监管不当的追责机制。其三是完善政府赔偿责任。食品安全事故导致了许多受害者的出现,如果政府在监管中没有尽到监管义务,那么政府对这些受害者应负有补充赔偿责任。文中提到食品安全监管中公务员引咎辞职制度,是2014年送审的食品安全法修改草案当中的亮点之一,政府赔偿责任也是食品安全领域研究的热点。论文研究内容具有时代性和进步性,期望能够对国家食品安全政府监管体系的建设略尽绵薄之力。
[Abstract]:In recent years, food safety events in China, whether in time or space, in terms of frequency or radiation range, have been beyond the reach of the past decades. The frequent occurrence of food safety accidents not only causes a lot of reversible or irreversible damage to the health of the general consumers, but also causes extremely bad consequences to the national food industry, and even more, The government is directly responsible for the oversight of food safety incidents, and the growing public distrust of the government has seriously affected the credibility of the government. In the supervision of food safety, the government, as the protector of public interest, the supervisor of public trust and the regulator of market operation, is responsible. This paper synthetically applies semantic analysis, comparative analysis and empirical analysis, from the angle of administrative law and economic law, puts forward questions, analyzes problems, compares them horizontally with developed countries, and interprets jurisprudence. Finally, the lack of government supervision responsibility for food safety and its countermeasures are discussed. After stating the current situation of food safety supervision in China and analyzing the lack of government responsibility and referring to the regulatory experience of developed countries (Japan and the United States), three countermeasures were finally drawn. One is to perfect the government's legislative responsibility. Improve food safety supervision laws and regulations, supervision and prevention system, related standards, accelerate the implementation of food information traceability system, food recall system and HACCP system. The second is to improve the responsibility of government law enforcement. To improve the awareness of supervision and enforcement of the government and regulatory departments, to improve the scientific and technological level of food safety inspection, and to implement the improper accountability mechanism of food safety supervision. Third, improve the government liability for compensation. Food safety accidents have led to the emergence of many victims, and if the government fails to comply with its regulatory obligations, the government should have supplementary liability for these victims. It is one of the highlights of the revised draft of food safety law submitted for review in 2014 that civil servants take the blame and resign in food safety supervision. Government liability is also a hot spot in the field of food safety. The content of this paper is of time and progress, and it is expected to contribute a little to the construction of the government supervision system of national food safety.
