我国食品安全私人监管刍议

【摘要】：《食品安全法》颁布实施后,我国食品安全环境较之以前有了很大改善。但是近几年食品安全事故的频繁发生说明,在私人主体和社会力量没有充分参与的情况下,单纯依赖政府进行的食品安全监管成效有限,不能满足公众对食品安全的需要。从多元治理角度出发,我们应当克服单纯依赖公权力的思维惯性,重视发辉私人主体参与监管的优势,在明晰政府监管界限、倡导私人主体互相监督、合理利用信息披露的基础上,完善食品安全私人监管,以便降低维护食品安全的成本,创造良好的食品安全环境。
[Abstract]:After the promulgation and implementation of the Food Safety Law, the food safety environment in China has been greatly improved. However, the frequent occurrence of food safety accidents in recent years shows that, without the full participation of private subjects and social forces, the effectiveness of food safety supervision solely dependent on the government is limited and can not meet the needs of the public for food safety. From the perspective of pluralistic governance, we should overcome the inertia of thinking relying solely on public power, attach importance to the advantages of Fa Hui's private subjects participating in supervision, clarify the limits of government supervision and advocate mutual supervision of private subjects. On the basis of reasonable use of information disclosure, the private supervision of food safety should be perfected in order to reduce the cost of maintaining food safety and create a good food safety environment.
