互联网医院法律地位与法律关系探讨——以“宁波云医院”为视角

【摘要】：明确互联网医院的法律地位及其与相关主体的法律关系,对于解决因互联网医疗引发的法律纠纷具有重要意义。实务中互联网医院的法律地位根据其业务类型的不同而有所变化。宁波云医院在远程会诊中是医疗服务的居间人;在检查检验和健康体检中,是医疗合同的当事人;在远程门诊中,既可能是医疗合同的当事人,也可能充当服务的第三方;而在预约挂号中,是医院的受托人,与患者之间不存在法律关系。
[Abstract]:It is of great significance to clarify the legal status of Internet hospitals and their legal relationship with related subjects for resolving legal disputes caused by internet medical treatment. In practice, the legal status of Internet hospitals varies according to their types of business. Ningbo cloud hospital is the intermediary of medical service in remote consultation, the party of medical contract in examination and examination, the party of medical contract in remote outpatient clinic, and the third party of medical service. And in the appointment registration, is the hospital trustee, does not have the legal relation with the patient.
