中国粮食金融化之法律应对

【摘要】：粮食金融化促使粮食由生活基本必需品走向投机商品,从满足生活需求转向满足投机需求。粮食金融化之法律应对应当彰显安全价值,对金融化行为进行类型化,旨在保障粮食权。其中,设立"粮食银行"是粮食金融化的前沿,必须加强政府监管、规范市场主体运行、促进行业自律;发展粮食期货是粮食金融化的核心,必须从市场准入、市场交易、市场退出进行全过程规制;健全粮食基金是粮食金融化的动力,必须合理使用粮食风险基金、促进商业性基金规模化、建立转基因粮食基金;创新粮食保险是粮食金融化的保障,必须拓展巨灾保险、健全粮食流通阶段的险种、推进粮食目标价格保险、建立转基因粮食保险。粮食金融化的法律研究有助于推进《粮食法》、《期货法》的制定,实现国家粮食安全与金融安全的有机统一。
[Abstract]:Grain financialization promotes grain from basic necessities to speculative commodities, from satisfying life demand to satisfying speculative demand. The legal response to the financialization of grain should show the value of safety and type the behavior of financialization in order to protect the right to food. Among them, the establishment of a "grain bank" is the forefront of grain financialization. It is necessary to strengthen government supervision, standardize the operation of the main body of the market, and promote self-discipline in the industry; the development of grain futures is the core of grain financialization, and it must be traded from market access and market access. It is necessary to make rational use of grain risk funds, to promote the scale of commercial funds and to set up genetically modified food funds. Innovating grain insurance is the guarantee of grain financialization. It is necessary to expand catastrophe insurance, perfect the insurance in grain circulation stage, promote grain target price insurance, and establish genetically modified grain insurance. The research on the law of grain financialization is helpful to promote the formulation of grain law and futures law and to realize the organic unification of national food security and financial security.
