论核法上安全与发展价值的衡平路径--以核管理机构的衡平责任为视角

【摘要】：安全与发展作为核法的核心价值,在其实现过程中一直处于不平衡的状态。衡平二者在核规则制定和项目决策中的关系,对规制核能风险、促进核能事业发展至关重要。限于核技术安全及核能风险在现实中难以确定,实现安全与发展价值衡平的路径不仅在于核法上的文本宣示,更取决于支配核管理机构裁量行为的伦理责任。核管理机构因其自身角色的双重性及其能力的不确定性,在规则制定和项目决策中应当树立风险预防理念和前瞻性责任意识,谨慎作为、量力而行,才能实现核法安全与发展价值衡平的目标。
[Abstract]:Security and development, as the core value of nuclear law, have always been in a state of imbalance in the process of its realization. The relationship between the two parties in the formulation of nuclear rules and project decision making is very important to regulate the risk of nuclear energy and promote the development of nuclear energy. The path of equitable value lies not only in the text Declaration on the nuclear law, but also on the ethical responsibility of controlling the discretion of the nuclear authority. Because of the dual character of its own role and the uncertainty of its ability, the nuclear management institution should set up risk prevention and forward-looking responsibility consciousness in the rule making and project decision-making. Only in this way can we achieve the goal of equitable balance between the safety and development of nuclear law.
