论地方立法审议程序制度的构建和完善——以设区的市的立法审议为视角

【摘要】：地方立法审议是享有立法权各级地方国家权力机关(即地方各级人大及其常委会)行使立法权的关键环节,也是提高地方立法质量的制度保障基础,但由于《立法法》中关于立法审议程序的相关规定原则性强、操作性差等原因,在很多地方对立法审议程序的构建缺乏适度创新,细化程度不够,导致地方立法审议活动缺乏详尽的运行规则和制度支撑,地方立法审议机制的构建尚存在诸多亟待突破之处。以设区的市的地方立法审议机制构建为视角,对地方立法审议机制进行研究与探索,对于建构符合设区的市的地方立法实践需要的立法审议机制具有重要的现实意义。通过对地方立法审议机制的探讨,有助于发挥好地方人大及其常委会在立法中的主导作用,推进科学立法与民主立法,确保地方立法质量。各设区的市应当广泛借鉴全国各地方立法的实践经验与做法,通过理论研究与实践思考,研究应对之策,提出解决办法,纠正相关机制建设的滞后性,克服实践操作中的无序性与盲目性,从而提高地方立法质量。
[Abstract]:The review of local legislation is the key link for the local organs of state power at all levels (that is, the local people's congresses and their standing committees) to exercise the legislative power, and is also the institutional guarantee basis for improving the quality of local legislation. However, due to the strong principle and poor maneuverability of the relevant provisions on the legislative review procedure in the Legislative Law, the construction of the legislative review procedure in many places lacks proper innovation and the degree of refinement is not enough. It leads to the lack of detailed operation rules and system support, and the construction of local legislative review mechanism is still in need of breakthrough. From the perspective of the construction of the local legislative review mechanism of the city with districts, it is of great practical significance to study and explore the local legislative review mechanism in accordance with the needs of the local legislative practice of the city with districts. The discussion on the deliberative mechanism of local legislation is helpful to give full play to the leading role of the local people's Congress and its standing committee in the legislation, to promote scientific legislation and democratic legislation, and to ensure the quality of local legislation. Cities divided into districts should extensively learn from the practical experience and practice of various local legislations throughout the country, through theoretical research and practical thinking, study countermeasures, put forward solutions, and correct the lag in the construction of relevant mechanisms. To overcome the disorder and blindness in practice and improve the quality of local legislation.
