违反治安管理行为与犯罪行为衔接问题的立法完善

【摘要】：一直以来,我国存在着违反治安管理行为与犯罪行为竞合的问题。2017年1月16日公安部公布的《治安管理处罚法修订公开征求意见稿》并没有着力解决这一重要问题,且新增的违反治安管理行为反而使固有的竞合问题愈发严重。导致竞合问题产生的根本原因是我国对二元治理模式的选择以及"质的区别说"与"量的区别说"的混合运用。只有解决竞合问题,才能在此基础上实现治安管理处罚与刑罚惩罚机制的协调与衔接。坚持和改造现有的二元制裁体系,并在其框架内正确运用"质量区别说"对违反治安管理行为与犯罪行为重新归类,配置符合各自制裁体系特点的处罚措施,方可有效消解竞合,实现二者的协调与衔接。
[Abstract]:All along, there is the problem of competing for violations of public security management and criminal acts in our country. On January 16, 2017, the revised draft of the Law on punishment for Public Security Administration issued by the Ministry of Public Security did not make efforts to solve this important problem. And the new violation of public order management behavior makes the inherent competition problem more serious. The root cause of the problem is the choice of dualistic governance mode and the mixed application of "qualitative difference theory" and "quantity difference theory". Only by solving the problem of concurrence can we realize the coordination and convergence of the punishment mechanism of public security management and penalty. Adhere to and reform the existing dual sanctions system, and correctly use the "quality distinction theory" within its framework to reclassify violations of public security management and criminal acts, and allocate punishment measures that conform to the characteristics of their respective sanctions systems, In order to effectively eliminate the competition and achieve the coordination and convergence between the two.
