【摘要】：地方立法是我国立法体制的重要组成部分,研究地方立法质量问题,有助于保障和发展社会主义民主,全面推进依法治国,促进国家治理现代化,完善中国特色社会主义法律体系。然而,我国学界对此所作的探讨和研究远远不够,现有研究主要是集中在地方立法质量的概念、地方立法质量的评价标准以及地方立法质量存在的问题等方面,而对造成我国地方立法质量不高的深层原因以及该采取哪些有效对策的研究较少。本文从理论研究和立法实践两个视角,深入分析我国地方立法质量方面存在的问题及其原因,提出相应的解决思路,以期丰富相关理论观点,并助益和服务于我国地方立法实践。本文共分为三个部分。第一部分论述地方立法质量的基本理论。首先,界定地方立法、地方立法质量等基础概念的内涵,确定本文的理论研究范畴;其次,阐述地方立法质量的现实意义,明确本文研究价值所在;最后,分析地方立法质量的评断标准,为下文研究作好铺垫。第二部分论述我国地方立法质量存在的问题并分析其原因。首先,梳理我国地方立法质量方面存在的问题,主要有越权立法、重复立法、滞后立法、地方立法中的部门利益、立法语言不规范等问题;其次,分析造成我国地方立法质量不高的原因,主要是地方立法理念有偏差、地方立法人员素质不高、地方立法权限不明晰、地方立法程序不完善、地方立法技术不成熟。第三部分论述保障我国地方立法质量的可行之策。针对问题及其原因,本部分提出了四个对策以保障我国地方立法质量。一是加强地方立法主体建设,主要包括树立以人为本的立法理念、充分发挥相关委员会的作用、提高人大代表的综合素质、优化地方立法主体的结构;二是明确地方立法权限,主要是明确中央与地方、省与设区的市、地方权力机关与地方政府、地方人大与其常委会之间的立法权限;三是完善地方立法程序,主要是完善地方立法规划程序、完善地方立法由法案到法的程序、完善地方立法的其他程序;四是提升地方立法技术,包括提升地方立法的结构技术和语言技术。
[Abstract]:Local legislation is an important part of our country's legislative system. Studying the quality of local legislation will help to ensure and develop socialist democracy, comprehensively promote the rule of law, and promote the modernization of national governance. We will improve the socialist legal system with Chinese characteristics. However, the academic circles in our country do not have enough research on this. The existing research mainly focuses on the concept of local legislative quality, the evaluation standard of local legislative quality and the problems existing in the quality of local legislation. However, there are few studies on the deep causes of the low quality of local legislation in China and the effective countermeasures to be taken. From the two perspectives of theoretical research and legislative practice, this paper deeply analyzes the problems and causes of the quality of local legislation in our country, and puts forward corresponding solutions in order to enrich the relevant theoretical viewpoints. And to help and serve the practice of local legislation in China. This paper is divided into three parts. The first part discusses the basic theory of the quality of local legislation. First, define the connotation of local legislation, local legislative quality and other basic concepts, determine the scope of theoretical research; secondly, explain the practical significance of the quality of local legislation, clarify the value of this study; finally, Analysis of the quality of local legislation evaluation standards, for the following research to pave the way. The second part discusses the problems existing in the quality of local legislation and analyzes the reasons. First, combing the problems existing in the quality of local legislation in China, such as ultra vires legislation, repeated legislation, lagging legislation, departmental interests in local legislation, non-standard legislative language, and so on. This paper analyzes the causes of the low quality of local legislation in our country, mainly due to the deviation of local legislative ideas, the low quality of local legislators, the unclear local legislative authority, the imperfect local legislative procedures and the immaturity of local legislative techniques. The third part discusses the feasible measures to guarantee the quality of local legislation in our country. Aiming at the problems and their causes, this part puts forward four countermeasures to ensure the quality of local legislation. First, to strengthen the construction of local legislative subjects, mainly including the establishment of a people-oriented legislative concept, to give full play to the role of relevant committees, to improve the comprehensive quality of deputies to the people's Congress, and to optimize the structure of local legislative subjects; second, to clarify the local legislative authority. It is mainly to clarify the legislative authority between the central and local authorities, provinces and municipalities divided into districts, local power organs and local governments, local people's congresses and their standing committees; third, to perfect the local legislative procedures, mainly to perfect the local legislative planning procedures. Perfecting the procedure of local legislation from bill to law, perfecting other procedures of local legislation; fourth, enhancing local legislative technology, including the structural technology and language technology of local legislation.
