【摘要】：人身自由权是受宪法保护的基本人权,采取对人身自由限制的行政拘留措施必须受到严格的法律制约。为保障人权,限制行政权力,2006年实施的《中华人民共和国治安管理处罚法》对行政拘留在内容有较大充实,同时在“处罚程序”和“执法监督”章节作出了详细、可操作的规定。行政拘留制度是治安管理行政处罚的四大类别之一,相较刑事领域而言,似乎被大众所忽略,其存在的问题也较少被关注、被研究。本文拟从行政拘留制度的沿革说起,沿着行政拘留制度发展的脉络,对比国外相关法律制度,对我国行政拘留制度的概念、特征进行剖析,进而论述我国行政拘留制度在决定主体、决定程序、监督机制及救济程序方面存在的问题,最后基于人权保护、公民参与、司法审查、权利救济四大原则出发提出完善措施。
[Abstract]:The right to personal liberty is a basic human right protected by the Constitution. In order to protect human rights and restrict administrative power, the Law of the people's Republic of China on the punishment of Public Security Administration in 2006 has enriched the content of administrative detention, and in the sections of "punishment procedure" and "Law Enforcement Supervision", Operational requirements. Administrative detention system is one of the four categories of administrative punishment in public security management. Compared with the criminal field, it seems to be ignored by the public, and its existing problems are less concerned and studied. This article begins with the evolution of the administrative detention system, along with the development of the administrative detention system, contrasts with the relevant foreign legal systems, and analyzes the concept and characteristics of the administrative detention system in our country. Then it discusses the problems existing in the system of administrative detention in deciding subject, deciding procedure, supervising mechanism and relief procedure. Finally, based on the four principles of human rights protection, citizen participation, judicial review and right relief, the author puts forward some perfect measures.
