开放政府下的信息公开:中国政府依申请公开信息的探索性研究

【摘要】：自1766年瑞典颁布《出版自由法》以来,信息公开已有250年历史。在民主法制建设的不断推进下,各国纷纷开展信息公开立法,不断完善信息公开制度。与此同时,中国政府信息公开制度与实践也在不断发展,《中华人民共和国政府信息公开条例》自2008年5月1日起正式实施,其在我国政府信息公开法制进程中具有里程碑意义。2009年奥巴马政府出台的一系列有关开放政府的政策对信息公开提出了新的要求,使得信息公开以新面貌再次进入公众的视野。本文关注于开放政府下的信息公开,在理解开放政府内涵与实践的基础上,明确信息公开在开放政府背景下的新要求,并结合中国政府信息公开,以开展政府信息依申请公开的22个国务院组成部委为调研对象,对其依申请公开信息的执行情况进行探索,以期为日后进一步研究奠定基础。
[Abstract]:Information has been made public for 250 years since Sweden promulgated the Freedom of the Press Act in 1766. With the development of democracy and legal system, many countries have developed information publicity legislation and improved the information disclosure system. At the same time, the system and practice of Chinese government information disclosure are also continuously developing. The regulations of the people's Republic of China on the publicity of Government Information have been formally implemented since May 1, 2008. In 2009, a series of open government policies introduced by Obama administration put forward new requirements for information disclosure, which made information disclosure enter the public vision again with a new look. This paper focuses on the information disclosure under the open government, on the basis of understanding the connotation and practice of the open government, clarifies the new requirements of the information disclosure under the background of the open government, and combines with the Chinese government information disclosure. In order to lay a foundation for further study, 22 ministries and commissions of the State Council that open government information according to application are taken as the research object, and the implementation of the information according to the application is explored.
