城乡规划视野下的英国保障性住房法研究

【摘要】：2005年,我国推行保障性安居工程以来,在越来越关注到城市发展的同时,更加注重兼顾公平,尤其是城市低收入人群的安居问题。因此,我国出台了一系列保障性住房相关的法律文件,建设一批廉租房、经济适用房,改造大量棚户区。但是,建设和改造由于不注重整体开发,忽略城乡规划对其的指导,几乎同时带来建设偏远,保障性住房规划不合理等问题,导致低收入人群二次失业、更加贫困。英国作为第一个完成工业化与城市化的国家,城乡规划法起源于对低收入人群住房的卫生改善,每一时期、每一次保障性住房法发展都伴随着不同时期不同的城市规划理念的影响与指导。城乡规划引导保障性住房法律制度建设,促使保障性住房法健康科学发展。英国保障性住房法的这一特点值得我们研究借鉴。因此,本文试图从梳理英国历史中城乡规划法对保障性住房不同时期的调整与影响的进程,总结规划法下的保障性住房法律制度建设的特点,分析造成这种流变的原因,并总结其中适合我国借鉴的经验,提出今后我国保障性住房法律制度发展的建议,推动保障性住房法律制度建设的全面发展。全文分为四个部分:第一部分为城乡规划视野下的保障性住房法律制度的变迁。从历史角度梳理了英国城乡规划法与保障性住房法的关系,从规划法对保障性住房法发展影响的角度将其分为三个阶段:城乡规划局部引导、全面引导和深入引导保障性住房法建设时期。通过对不同阶段调整重点和内容侧重不同的分析,为总结保障性住房法发展特点、分析造成此种特点的原因做好铺垫。第二部分总结了城乡规划法引导下的保障性住房法的特征。分别为:控制规划指导保障性住房法制度构建、城市功能区划中的保障性住房选址制度、权责清晰的政府主导开发模式、住房法中的全程性公众参与规划开发。第三部分分析造成保障性住房法上述特征的原因。归结为:执政党政策变迁的指引、民主政治进步的推动、多元法学思潮的影响、英国法律传统的沿袭。第四部分总结城乡规划视野下英国保障性住房法律制度建设经验的当代启示。本部分先分析了我国保障性住房法律制度体系建设中存在问题:保障性住房法律体系构建失衡、保障性住房选址与城市功能区划协调性差、保障性住房规划开发中政府权责模糊、规划开发中的公众参与开放不够。针对存在问题提出英国保障性住房法律制度建设经验对中国的启示:构建规划与住房平衡的法律体系、坚守规划引导保障性住房开发、强化规划开发中的公众参与监督、明晰保障性住房规划开发中的政府权责。最后一部分是结论,概括了全文的核心观点。
[Abstract]:Since 2005, China has paid more and more attention to the urban development, especially to the problem of urban low-income people living in peace while paying more and more attention to the urban development. Therefore, China has issued a series of legal documents related to affordable housing, construction of a number of low-rent housing, comfortable housing, the transformation of a large number of shantytowns. However, construction and transformation, because they do not pay attention to the overall development, ignore the guidance of urban and rural planning, almost at the same time bring about the construction of remote, affordable housing planning unreasonable and other problems, resulting in low-income people secondary unemployment, more poverty. As the first country to industrialize and urbanize, the urban-rural planning law originates from improving the sanitation of low-income housing. Every development of indemnificatory housing law is accompanied by the influence and guidance of different urban planning ideas in different periods. Urban and rural planning to guide the construction of affordable housing legal system, promote the healthy and scientific development of affordable housing law. This characteristic of the British indemnificatory housing law is worthy of our study and reference. Therefore, this paper attempts to comb the process of adjustment and influence of urban and rural planning law on affordable housing in British history, summarize the characteristics of the legal system construction of affordable housing under the planning law, and analyze the reasons for this kind of change. The author also summarizes the experience which is suitable for our country, and puts forward some suggestions for the development of the legal system of indemnificatory housing in China in the future, so as to promote the overall development of the legal system of indemnificatory housing. The thesis is divided into four parts: the first part is the change of the legal system of the indemnificatory housing in the view of urban and rural planning. This paper combs the relationship between the urban and rural planning law and the indemnificatory housing law from the historical point of view, divides it into three stages from the perspective of the influence of the planning law on the development of the indemnificatory housing law: the partial guidance of urban and rural planning, Guide and thoroughly guide the construction period of indemnificatory housing law. Through adjusting the emphases and contents in different stages, this paper lays a good foundation for summing up the characteristics of the development of the indemnificatory housing law and analyzing the causes of the characteristics. The second part summarizes the characteristics of the indemnificatory housing law under the guidance of urban and rural planning law. Respectively: control planning to guide the construction of affordable housing law system, urban functional zoning of affordable housing location system, clear responsibility of the government-led development model, housing law in the full process of public participation in planning and development. The third part analyzes the reasons for the above characteristics of the indemnificatory housing law. It can be summed up as: the guidance of the change of the ruling party's policy, the promotion of democratic political progress, the influence of the pluralistic trend of legal thought, and the inheritance of the British legal tradition. The fourth part summarizes the contemporary enlightenment from the perspective of urban and rural planning in the construction of the legal system of affordable housing in Britain. This part first analyzes the problems existing in the construction of the legal system of affordable housing in China: the imbalance in the construction of the legal system of affordable housing, the poor coordination between the location of affordable housing and the urban functional zoning. In the planning and development of affordable housing, the authority and responsibility of the government are vague, and the public participation in the planning and development is not enough. In view of the existing problems, this paper puts forward the enlightenment to China from the experience in the construction of the legal system of affordable housing in Britain: to construct a legal system of planning and housing balance, to adhere to the planning and guide the development of affordable housing, and to strengthen the supervision of public participation in the planning and development. Make clear the government's rights and responsibilities in the planning and development of affordable housing. The last part is the conclusion, summarized the core point of view of the full text.
