劳动者检举权的法律保护制度研究

【摘要】：近年来,劳动者因检举而遭受不平等待遇的问题越来越受到社会的关注,这就直接拷问着我国劳动者检举权的法律保护制度。检举权属于我国劳动法赋予劳动者的应有监督权之一,借助在企业或单位所处特别位置的劳动者将有助于在维护国家和社会公共利益方面发挥至关重要的作用。随着我国社会主义法治建设的不断推进,劳动者检举权的法律保护制度研究已迫在眉睫,而我国现行的法律法规对于劳动者检举权的规定基本都是原则性规定,且对检举人的保护、惩罚措施也多依据其他法律来间接实施,可操作性不强,导致劳动者检举权的行使困难重重,严重打击了劳动者检举的积极性。本文将从以下几方面对劳动者的检举权展开研究:首先,通过对国内外检举及检举权定义的深入剖析,进一步得出劳动者检举权的应有涵义、与公民检举权的差异及保障劳动者检举权的现实意义,旨在对劳动者检举权有一个宏观透彻的理解。其次,通过运用比较分析的方法,对我国现行法律中劳动者检举权的相关规定进行了梳理,并通过对域外主要国家内部检举人保护制度的研究分析,着重深刻剖析我国劳动者检举权保护制度目前存在的主要问题,进而针对性地提出相应的解决思路,促进劳动者检举权法律保护制度的进一步完善,推进中国特色社会主义法治建设的发展。最后,在对我国劳动者检举权法律保护制度存在的问题进行分析时,主要是以保护机制、奖励机制和救济机制三个方面为视角,并结合对典型案例的分析,分别对当前我国劳动者检举权相关保护规定所存在的问题及缺陷提出了完善的立法建议和具体构想,以期完善我国劳动者检举权的法律保护制度。
[Abstract]:In recent years, more and more attention has been paid to the unequal treatment of workers due to whistleblower, which directly tortures the legal protection system of workers' right to report. The right to report belongs to one of the rights of supervision given by the labor law of our country. The help of the laborer in the special position of the enterprise or unit will help to play a vital role in safeguarding the national and social public interests. With the development of socialist rule of law in our country, it is urgent to study the legal protection system of workers' reporting right. However, the current laws and regulations of our country are basically principled provisions for workers' right to report. And the protection of whistleblowers, punishment measures are also based on other laws to implement indirectly, the operability is not strong, resulting in the exercise of the right to report workers difficulties, seriously hit the enthusiasm of workers to report. This article will carry on the research from the following several aspects to the laborer's reporting right: first, through the thorough analysis to the domestic and foreign prosecution and the reporting right definition, further obtains the laborer to report the right to have the meaning, The purpose of this paper is to have a macroscopic and thorough understanding of the right of workers to report, which is different from that of citizens and the practical significance of protecting the right of workers to report. Secondly, by using the method of comparative analysis, this paper combs the relevant provisions of the laborer's reporting right in the current law of our country, and through the research and analysis of the internal whistleblower protection system of the main foreign countries, The main problems existing in the protection system of workers' reporting right in our country are deeply analyzed, and the corresponding solutions are put forward to promote the further improvement of the legal protection system of workers' reporting right. Promoting the development of socialist legal construction with Chinese characteristics. Finally, in the analysis of the problems existing in the legal protection system of the workers' reporting right in China, we mainly take the protection mechanism, the reward mechanism and the relief mechanism as the visual angle, and combine the analysis of the typical cases. In order to perfect the legal protection system of workers' reporting right, this paper puts forward some perfect legislative suggestions and concrete ideas on the problems and defects of the relevant protection provisions of the workers' reporting right in our country at present.
