德国部长问责制的构成及其实现方式

【摘要】：在德国官员问责法律体系中,部长基于其在德国《基本法》中特殊的法律身份,处于宪法位阶的部长问责制监督之下而不受一般公务员法意义上问责制度的制约。与一般官员问责制所表现出的法律责任属性不同,德国《基本法》框架下的部长问责属于政治问责范畴。部长问责制所表现出的特殊性与该制度在德国历史上的发展直接相关,很多具体的问责规定均系继承历史制度的基础上形成。有必要在总结历史发展的基础上对德国部长问责制的构成及其实现方式进行详细梳理。
[Abstract]:In the legal system of official accountability in Germany, ministers, based on their special legal status in the basic Law of Germany, are under the supervision of the constitutional level of ministerial accountability and are not restricted by the system of accountability in the sense of general civil service law. The accountability of ministers under the framework of the basic Law of Germany belongs to the category of political accountability. The particularity of the ministerial accountability system is directly related to the development of the system in German history, and many specific accountability provisions are formed on the basis of inheriting the historical system. It is necessary to carve out the constitution and realization of German ministerial accountability system on the basis of summing up the historical development.
