以平衡论为导向的基层行政处罚规范性和技巧性探讨

【摘要】:中共十八大报告指出:当前我国社会矛盾明显增多,教育、就业、社会保障、医疗、住房、生态环境、食品药品安全、安全生产、社会治安、执法司法等关系群众切身利益的问题较多。必须坚持社会主义政治发展道路和推进政治体制改革,全面推进依法治国。要推进科学立法、严格执法、公正司法、全民守法,坚持法律面前人人平等,保证有法必依、执法必严、违法必究。未来我国必须坚持走中国特色社会主义法律体系,加强重点领域立法,拓展人民有序参与立法途径。推进依法行政,切实做到严格规范公正文明执法。目前我国社会处于转型升级的关键时期,各种矛盾充斥在不同阶层、不同行业之间,例如官民矛盾、贫富差距矛盾等等,很大程度上影响着社会稳定和依法治国进程。在官民矛盾,即公权力与私权利矛盾中,一个很重要的矛盾集中体现在基层行政处罚中,也引发不少舆论事件为社会所关注。究竟该如何对基层行政处罚进行规范,如何更为有效地进行行政处罚,平衡论的提出和发展为其提供了基础指导性的研究思路。 为此,本文以行政法平衡论为基础导向,综合运用公共管理学、社会学、心理学等理论,以笔者所从事工作的D市行政处罚情况为载体,对基层行政处罚情况进行初步分析,找出存在的问题,并提出新形势下的解决措施和规范思路。 全文共分为四部分。第一部分是绪论。重点讲述文章研究的目的和意义,提出研究的思路和方法。第二部分是理论和概念,讲述行政处罚和平衡论的相关概念和内涵,指出平衡论在我国行政法中的发展和运用。第三部分是重要性分析。指出利用平衡论指导行政处罚的重要意义,集中体现在规范性指导和技巧性指导方面,以此提出判断行政处罚先进性和合理性的判断标准。四是问题剖析。以D市为例,分析行政处罚基本情况,找出存在的主要问题和矛盾,主要是外部体制环境和内部人员两方面。五是解决思路。以平衡论为指导,提出各种体制规范和工作规范,为执法人员提供技巧性参考。
[Abstract]:The report of the 18th National Congress of the Communist Party of China pointed out: at present, there is a marked increase in social contradictions in our country: education, employment, social security, medical care, housing, ecological environment, food and drug safety, production safety, social security, There are many issues concerning the vital interests of the masses, such as law enforcement and administration of justice. We must adhere to the road of socialist political development, push forward the reform of political system, and comprehensively advance the rule of law. It is necessary to promote scientific legislation, strictly enforce the law, enforce the law impartially, and abide by the law by the whole people, adhere to the principle of equality before the law, ensure that there are laws that must be followed, enforce the law strictly, and prosecute violations of the law. In the future, China must adhere to the socialist legal system with Chinese characteristics, strengthen legislation in key areas, and expand the ways for the people to participate in legislation in an orderly manner. We will promote administration according to law and strictly standardize fair and civilized law enforcement. At present, our society is in the critical period of transformation and upgrading. All kinds of contradictions are filled in different strata and industries, such as the contradiction between the government and the people, the gap between the rich and the poor, and so on, which to a great extent affect the social stability and the process of governing the country according to law. In the contradiction between the government and the people, that is, the contradiction between public power and private right, a very important contradiction is concentrated in the grass-roots administrative punishment, which also causes a lot of public opinion events to be paid attention to by the society. How to regulate the basic administrative punishment and how to carry on administrative punishment more effectively, the balance theory provides the basic guiding research thought for it. Therefore, this paper, based on the balance theory of administrative law, synthetically applies the theories of public management, sociology, psychology and so on, taking the D city administrative punishment situation of the author's work as the carrier, carries on the preliminary analysis to the basic level administrative punishment situation. To find out the existing problems, and put forward the solution under the new situation and standardized ideas. The full text is divided into four parts. The first part is the introduction. The purpose and significance of the research are mainly described, and the ideas and methods of the research are put forward. The second part is the theory and the concept, narrates the administrative punishment and the balance theory related concept and the connotation, points out the balance theory in our country administrative law development and the application. The third part is the importance analysis. This paper points out the significance of using balance theory to guide administrative punishment, which is embodied in normative guidance and technical guidance, and puts forward the judgment standard for judging the progressiveness and rationality of administrative punishment. Fourth, problem analysis. Taking D city as an example, this paper analyzes the basic situation of administrative punishment and finds out the main problems and contradictions, mainly external system environment and internal personnel. Fifth, solve the train of thought. Under the guidance of balance theory, various institutional norms and working norms are put forward to provide technical reference for law enforcement personnel.
