论高等教育中外合作办学的法律问题

【摘要】:2001年我国加入WTO之后承诺对教育市场实行有限开放。全球经济一体化的不断深入,推动了我国高等教育的不断发展,也使得我国中外合作办学进入了一个新的阶段,办学形式日益多样,办学规模、层次和模式都有了很大的变化,这在引进国外优秀的管理经验和教学经验方面都发挥了积极的作用,提升了我国的高等教育质量的同时,也推动了中外合作办学在我国的发展。截至2013年底,依据《中华人民共和国中外合作办学条例》及其《中华人民共和国中外合作办学条例实施办法》批准设立的高等教育中外合作办学机构和中外合作项目已经达到近2300个。我国已经初步形成了以《中华人民共和国中外合作办学条例》及《中华人民共和国中外合作办学条例实施办法》为核心的中外合作办学法律体系,但仍然面临着诸多法律问题。为此,有必要在分析我国高等教育合作办学及其法律规制现状的基础上,以全球化、国际化的视野,在借鉴域外高等教育合作办学的经验的同时,立足于我国国情,不断完善我国相关立法,使我国高等教育合作办学法律体系更加符合国际教育发展的需求。 本文针对高等教育中外合作办学中教育主权泛化、国内教育立法滞后、国内法规则与国际法规则相冲突等法律问题,通过借鉴英国、美国、澳大利亚、香港等典型国家和地区有关教育主权的认识以及质量保障和监管机制方面的经验,建设性地提出了树立教育主权发展观,坚持教育主权的可分解性和层次性,把“中外合作办学走出去战略”加入相关法规,完善高等教育合作办学的学历互认制度和监管机制,修改相关教育法规的“营利性”内容,以促进我国高等教育合作办学更好更快发展。
[Abstract]:After China's entry into the WTO in 2001, China promised to open a limited opening to the education market. The continuous deepening of the global economic integration has promoted the continuous development of higher education in our country. It has also made China's Chinese and foreign cooperation in running a new stage, and the form of running a school is increasingly diverse, the scale, the level and mode of running a school have been greatly changed, which is introduced Foreign excellent management experience and teaching experience have played a positive role, promoted the quality of higher education in China, and promoted the development of Chinese and foreign cooperation in running schools in China. By the end of 2013, according to the regulations on running schools in People's Republic of China and the regulations of Chinese and foreign cooperation in running schools in People's Republic of China Methods > there have been nearly 2300 Chinese and foreign cooperative institutions and Chinese and foreign cooperation projects approved for higher education. China has initially formed the legal system of running a school with China and foreign countries at the core of the regulations on running schools for Chinese and foreign cooperation in People's Republic of China and the implementation of the regulations for running running schools in People's Republic of China. Therefore, it is necessary to analyze the current situation of the cooperation in running higher education and its legal regulation in China, on the basis of globalization and internationalization, and on the basis of the national conditions of our country, and constantly improve the relevant legislation of our country, so as to make the legal body of the cooperation of higher education in our country. The Department is more in line with the needs of the development of international education.
This article is aimed at the generalization of educational sovereignty, the lag of domestic education legislation, the conflict of domestic law rules and the rules of international law, and the construction of the knowledge of educational sovereignty in the typical countries and regions such as the United Kingdom, the United States, Australia and Hongkong, and the experience of the quality assurance and supervision mechanism. It puts forward the concept of developing the development of educational sovereignty, insisting on the decomposability and hierarchy of educational sovereignty, adding relevant laws and regulations, perfecting the system of mutual recognition and supervision of educational background of higher education, and revising the "profit" content of relevant educational regulations so as to promote the cooperation of Higher Education in China. Running a school is better and faster.
