青岛市城市房屋征收补偿问题研究

【摘要】:在针对我国国有土地上房屋征收的公共政策研究中,借鉴其他国家和地区对城市房屋征收的一般理论、经验,结合我国经济社会发展的实际,通过充分对比、分析,总结梳理出现阶段我国国有土地上房屋征收与补偿的对策建议,具有较强的现实意义。本文拟从立法主旨出发,准确把握立法原文和学理涵义,在此基础上对实践中的征收补偿标准进行逐一评价,分析其合理性与存在的问题;最后进一步有针对性地提出完善青岛市房屋征收补偿制度的有效途径。政府在城市房屋征收中涉及诸多问题,对上述涉及的问题逐一分析并提出对策建议是本文的主要理论创新之处。在内容上,本文通过研究青岛市房屋征收补偿中的种种问题,从公共利益如何界定、信息公开制度的完善、征收评估程序的优化、听证程序的规范、补偿标准的合理化几个方面,逐一提出改进对策及完善建议,以进一步探索征收补偿标准的完善途径,规范行政征收行为。鉴于公共利益法律概念的抽象性和不确定性,笔者提出了判定公共利益的初步设计思路,即坚持程序性标准和实质性标准,在程序性标准方面,设计征收之前的听证会等正当程序;在实质性标准方面,要遵循比例原则、少数服从多数原则来考量公共利益是否存在,并辅之以司法审查程序予以保障。针对信息公开规定不够完善的现状,提出从丰富完善应当公开事项、建立全程监督的房屋征收工作制度、推进信息化管理、积极接受社会监督四个方面完善征收信息公开制度。针对目前听证应用的范围比较狭窄的弊端,建议从建立征收决定事前听证制度、规范房屋征收听证程序两个方面完善征收听证程序。针对房屋评估流于形式的现象,建议从建立评估机构准入机制、合理把握评估原则、评估机构选定及评估流程的规范透明、救济程序四个方面完善征收评估制度;最后,针对房屋征收问题中的矛盾的关键即补偿标准问题,提出解决征收拆迁补偿争议的根本途径,即:改进房屋补偿标准内容、对房屋承租人给与公平补偿、丰富完善非住宅房屋补偿标准体系,完善征收补偿标准,建立公平合理的补偿标准体系。
[Abstract]:In the research on the public policy of housing expropriation on the state-owned land of our country, this paper draws lessons from the general theory and experience of other countries and regions on the collection of urban houses, combines with the reality of our country's economic and social development, and through the full comparison, analyzes, It is of great practical significance to summarize the countermeasures and suggestions of housing expropriation and compensation on state-owned land in China. Based on the legislative purport, this paper accurately grasps the original legislation and the theoretical meaning, and then evaluates the standard of levy and compensation one by one in practice, and analyzes its rationality and existing problems. Finally, an effective way to perfect the compensation system of housing collection in Qingdao is put forward. The government involves many problems in urban housing expropriation. The main theoretical innovation of this paper is to analyze the above problems one by one and put forward countermeasures and suggestions. In terms of content, this paper studies various problems in housing expropriation and compensation in Qingdao, from how to define the public interest, how to perfect the system of information disclosure, how to optimize the procedure of expropriation and evaluation, and how to standardize the procedure of hearing. In order to further explore the ways of perfecting the standard of compensation and standardize the behavior of administrative expropriation, this paper puts forward some countermeasures and suggestions for the rationalization of the standard of compensation one by one. In view of the abstractness and uncertainty of the legal concept of public interest, the author puts forward the preliminary design idea of judging public interest, that is, insisting on the procedural standard and substantive standard, and in the aspect of procedural standard, In the aspect of substantive standards, the principle of proportionality should be followed, the minority should consider the existence of public interest from the principle of majority, and be protected by judicial review procedure. In view of the present situation that the regulation of information disclosure is not perfect, this paper puts forward four aspects of perfecting the open system of expropriation information from the aspects of enriching and perfecting the matters that should be made public, establishing the house levy work system of the whole course supervision, promoting the information management, and accepting the social supervision actively. In view of the narrow scope of application of the hearing at present, it is suggested to perfect the procedure of expropriation hearing from the following two aspects: establishing the system of prior hearing of expropriation decision and standardizing the hearing procedure of house expropriation. In view of the phenomenon that housing evaluation is formalized, it is suggested that the assessment system should be improved from four aspects: establishing the admission mechanism of the evaluation institution, reasonably grasping the evaluation principle, standardizing and transparent the evaluation process, and the relief procedure. Aiming at the problem of compensation standard, which is the key of the contradiction in the problem of house expropriation, the paper puts forward the basic way to solve the dispute of compensation for expropriation and demolition, that is, to improve the content of the standard of housing compensation, and to give fair compensation to the house lessee. Enrich and perfect non-residential housing compensation standard system, perfect levy compensation standard, establish fair and reasonable compensation standard system.
