医疗道歉法与医疗纠纷解决机制的发展——美国经验与中国进路

【摘要】：为缓和医患矛盾,化解医疗责任保险危机,以患者安全为目的,以医疗道歉法为核心的医疗纠纷解决机制在美国得以兴起。医疗过失的主要成因为医疗体系的系统性失灵,为保证患者安全,医疗纠纷立法应立足于发现和避免医疗过失。为保护和鼓励医疗机构就医疗不良后果向患者做出歉意表达,部分州法规定了医疗过失道歉法,免除医方歉意表达的证据效力,并建立了医疗过失报告制度。在此基础上医疗机构和保险公司构建了以患者安全为导向的非诉讼纠纷解决机制。我国的医疗纠纷解决机制应以保障患者安全为出发点,建立强制和保密性医疗不良后果披露制度,将不良后果纳入患者知情同意权的范围,同时以医疗道歉法保护和鼓励医疗机构以非诉讼机制解决医患纠纷。
[Abstract]:In order to ease the contradiction between doctors and patients and resolve the crisis of medical liability insurance, the medical dispute resolution mechanism, which aims at patient safety and takes medical apology law as the core, has emerged in the United States. The main cause of medical negligence is the systematic failure of medical system. In order to ensure the safety of patients, the legislation of medical disputes should be based on the discovery and avoidance of medical negligence. In order to protect and encourage medical institutions to express their apologies to patients about the adverse consequences of medical treatment, some state laws stipulate the medical negligence apology law, exempt the evidential effect of medical apology expression, and establish a medical negligence reporting system. On this basis, medical institutions and insurance companies construct a non-litigation dispute resolution mechanism based on patient safety. The medical dispute resolution mechanism of our country should take the protection of patients' safety as the starting point, establish the system of compulsory and confidential disclosure of adverse medical consequences, and bring the adverse consequences into the scope of patients' right of informed consent. At the same time, the medical apology law is used to protect and encourage medical institutions to resolve doctor-patient disputes by non-litigation mechanism.
