行政法文化视域下官民理念的转换

【摘要】：行政法文化是一个国家行政法治建设的核心灵魂,同样行政法文化也影响着一国行政法治建设的水平。官与民的理念是行政法文化的核心精神与灵魂,同样官、民理念的转换表征着行政法文化的发展与变迁的历史脉络。本文以当代行政法文化中官、民的思想理念,思维习惯,情感表达,以及行为方式等精神因素的转变为研究重点,结合现实政治生活中的经典案例,从而分析我国当代行政法文化发展过程之中存在的问题与矛盾。回首我国改革开放及行政法治建设30余年的历程里,我们发现我国的行政法文化正经历着时代性的变革,现代的行政法文化理念正走入我们的生活之中。对于我国行政法治的建设能否取得成效,其至关重要的是行政主体与行政相对人能否建立起符合当代法治精神及原则的思想理念,在行政法治建设中,行政主体的执政方式和行政理念作为行政主体是否拥有法律意识的主要参考,此外,行政相对人能否依法行使和保护自身权利的法律意识是行政法治建设的重要基石。由于我国是一个拥有长期“官本位”思想和“人治”色彩极其浓重的国家,在行政执法的过程中部分执法人员仍受传统行政法文化的影响,对于行政法治理念的理解仅仅停留在其表面,导致行政腐败,行政冷暴力等事件频频发生。因此,对行政法文化视域下官、民理念的完善与重构有助于营造和谐安定的行政法治建设环境,加快行政法治建设的步伐,从而呈现具有中国特色的行政法文化。
[Abstract]:The culture of administrative law is the core soul of the construction of a country's administrative rule of law, and the same culture of administrative law also influences the level of the construction of a country's administrative rule of law. The concept of officials and the people is the core spirit and soul of administrative law culture. Similarly, the transformation of the concept of officials and the people represents the historical context of the development and change of administrative law culture. This paper focuses on the transformation of the spiritual factors, such as the ideology, thinking habits, emotional expression and behavior style of the officials and the people in the contemporary administrative law culture, and combines with the classic cases in the real political life. In order to analyze the problems and contradictions in the process of the development of contemporary administrative law culture in China. Looking back on the course of our country's reform and opening up and the construction of administrative rule of law for more than 30 years, we find that our administrative law culture is undergoing the change of the times, and the modern administrative law cultural concept is entering our life. Whether the construction of the administrative rule of law in our country can achieve success, the most important thing is whether the administrative subject and the administrative counterpart can establish the ideological idea which accords with the spirit and principle of the contemporary rule of law, and in the construction of the administrative rule of law, As the main reference of whether the administrative subject has the legal consciousness, the administrative subject's ruling mode and the administrative idea are the important foundation of the construction of the administrative rule of law. In addition, the legal consciousness of whether the administrative counterpart can exercise and protect his own rights according to law is the important cornerstone of the construction of administrative rule of law. As China is a country with a long history of "official standard" and "rule by man", some law enforcement personnel are still affected by the traditional administrative law culture in the process of administrative law enforcement. The understanding of the concept of administrative rule of law only stays on its surface, which leads to administrative corruption, administrative cold violence and other events. Therefore, the perfection and reconstruction of the concept of the government and the people from the perspective of administrative law culture will help to create a harmonious and stable environment for the construction of the administrative rule of law, speed up the pace of the construction of the administrative rule of law, and thus present the administrative law culture with Chinese characteristics.
