城管事权的法理构筑——从相对集中处罚权到大城管立法

【摘要】：在当前城管执法面临的诸多问题中,首当其冲的是"事权"问题,主要是指在行政管理的诸多领域中,城管部门与其他部门在执法事项上的权限归属。尽管始于2000年前后的相对集中处罚权制度能够较为有效地解决多头执法、多头处罚等问题,但又引发了种种新的问题;并且更为重要的是,城管作为一个单一的执法部门,能够掌管无限多样的执法事项显然不存在充分的法理正当性。而晚近部分地方开展的"大城管立法",则通过"指挥机构的统一调度"和"管理对象下的事权明晰"这两个核心机制,为城管事权困境的解决提供了一种制度方案或者可供试错的借鉴。
[Abstract]:Among the problems faced by chengguan law enforcement at present, the most important problem is "power of administration", which mainly refers to the ownership of jurisdiction between chengguan department and other departments in law enforcement matters in many fields of administration. Although the relatively centralized punishment system, which began around 2000, can more effectively solve the problems such as long enforcement, long punishment and so on, it has also caused various new problems; and more importantly, as a single law enforcement department, urban management has become a single law enforcement department. It is clear that there is no sufficient legal legitimacy to be in charge of unlimited variety of law enforcement matters. In recent years, the "Great chengguan legislation" developed in some parts of the country has been implemented through the two core mechanisms of "unified dispatch of command organs" and "clarity of administrative power under management objects." It provides a system scheme or a reference for trial and error to solve the plight of urban management power.
