人类辅助生殖技术的法律规制

【摘要】：人类辅助生殖技术，Assisted Reproductive Technology，简称ART，是生物技术当中的高端科技。因其剧烈地冲击着人类有史以来的自然传统生殖方式，而引起了人类巨大的争论，故为世人所熟知。毫无疑问，辅助生殖技术为人类繁衍后代提供了一种全新的方式。然而技术在社会当中的运用涉及到复杂的伦理、法律等各方面问题，文章从人类辅助生殖技术的概念和种类出发，分析该技术的价值、分别提出该技术中有代表性的代孕和人工授精的相关法律问题、论述我国对该技术的法律政策完善建议，以期使其能更好地服务于社会，更有利于保障人类辅助生殖中各方当事人之间的权益。在论文写作之前，笔者查阅了国内外相关的法律法规、大量的文献资料和官方统计数据，，并进行整理、归纳，在某些问题上形成了独到的观点，以供读者参考。
[Abstract]:Assisted Reproductive Technology (art) is a high-end technology in biotechnology. Because of its violent impact on the human history of natural traditional reproductive mode, and caused a great deal of debate, so the world is well-known. There is no doubt that assisted reproductive technology provides a new way for humans to reproduce. However, the use of technology in society involves complex ethical, legal and other issues. This paper analyzes the value of the technology from the concept and variety of human assisted reproductive technology. This paper puts forward the representative legal problems of surrogacy and artificial insemination in this technology, and discusses the legal policy improvement suggestions of this technology in our country, in order to make it better serve the society. More conducive to the protection of human assisted reproduction between the rights and interests of the parties. Before writing the paper, the author consulted the relevant laws and regulations at home and abroad, a large number of documents and official statistics, and collated, summed up, on some issues formed a unique point of view, for the reader's reference.
