城市房屋征收补偿中违法建筑问题的法律思考

【摘要】：在城镇建设加快和供给侧结构性改革大力推进的情形下,探讨城市房屋征收和补偿制度在学术界和实务界都有重要价值。本篇文章在分析我国城市房屋征收与补偿制度实施现状的前提下,通过对比行政法规和地方规章中有关房屋征收补偿制度中的违法建筑问题,并针对新颁布的《南京市国有土地上房屋征收与补偿办法》的亮点之处,从违法建筑的补偿问题、认定违法建筑的公民参与问题、违法建筑的司法强迁问题等三个问题入手具体探讨我国违法建筑补偿制度。本文研究在2017年《南京市国有土地上房屋征收与补偿办法》新增加内容的基础上进行论证,采取了案例分析、比较分析等研究方法,辅之以中国裁判文书网中的相关案例,对其中存在的若干问题加以分析,从而找出问题症结所在以及要完善的方向。本文的段落结构如下.:第一部分,明晰了城市房屋征收补偿和违法建筑的概念,指出在房屋征收补偿中违法建筑的形成原因,进而梳理并引出违法建筑补偿问题、认定违法建筑的公民参与问题、违法建筑的司法强迁问题。第二部分,就违法建筑不予补偿的规定,首先,分析城市房屋征收中违法建筑的现实问题;然后,通过对违法建筑私权属性进行理性界定;最后提出处理违法建筑的区别对待措施。第三部分,探讨城市房屋征收中认定违法建筑的公民参与问题,在分析公民参与的概念和认定违法建筑中公民参与存在问题之后,进而提出构建城市房屋征收中认定违法建筑的公民参与机制。第四部分,在对违法建筑的司法强迁进行理论概述与合理性分析的基础上予以反思,从必要性分析、完善立法举措、构建裁执分离模式三个方面提出建立和完善违法建筑的司法强迁制度建议。
[Abstract]:With the acceleration of urban construction and the vigorous promotion of supply-side structural reform, it is of great value to discuss the system of urban housing levy and compensation in both academic and practical circles. Based on the analysis of the present situation of the implementation of the urban housing collection and compensation system in China, this article compares the illegal building problems in the housing collection and compensation system between the administrative regulations and local regulations. In view of the bright spots of the newly promulgated measures on Housing Collection and compensation on State-Owned Land in Nanjing, from the problem of compensation for illegal buildings, the problem of citizen participation in illegal buildings is determined. This paper discusses the compensation system of illegal building in China. On the basis of the new contents of the 2017 "measures for expropriation and compensation of Housing on State-Owned Land in Nanjing", this paper has adopted case analysis, comparative analysis and other research methods, supplemented by relevant cases in China's judgment documents Network. Some existing problems are analyzed to find out the crux of the problem and the direction of perfection. The paragraph structure of this paper is as follows: in the first part, the concepts of urban house levy compensation and illegal building are clarified, and the formation reasons of illegal building in the building levy compensation are pointed out, and then the compensation problem of illegal building is sorted out. The problem of citizen participation in illegal building and the problem of judicial forced relocation of illegal building. The second part is about the stipulation that illegal building is not compensated. Firstly, it analyzes the realistic problems of illegal building in the collection of urban house, and then, through the rational definition of private right attribute of illegal building; Finally, the paper puts forward the measures to deal with illegal buildings. The third part discusses the problem of citizen participation in illegal buildings in urban housing collection, after analyzing the concept of citizen participation and the existing problems of citizen participation in the identification of illegal buildings. And then put forward the construction of urban housing collection in the identification of illegal building citizen participation mechanism. The fourth part, on the basis of the theoretical overview and rational analysis of the judicial forced relocation of illegal buildings, from the necessity of analysis, improve legislative measures, This paper puts forward some suggestions on establishing and perfecting the system of judicial forced relocation of illegal buildings in the three aspects of constructing the separation mode of adjudication and enforcement.
