论我国政府权力清单制度的法制化途径

【摘要】:2015年3月,中共中央办公厅和国务院办公厅联合印发了《关于推行地方各级政府工作部门权力清单制度的指导意见》,在《意见》中明确指出,推行政府权力清单制度是我国治理体系和治理能力进行现代化建设的重要方面,并且明确提出在2015年年底以前,各省级政府要完成行政权力的公布工作。在对权力清单进行梳理的过程中,笔者针对我国政府权力清单制度在推行的过程中所暴露出的法律问题进行梳理和归纳,提出了我国政府权力清单制度在法制化途径中面临的主要问题,并就如何更有效地推动权力清单制度法制化提出了相应的解决对策。本文认为,制约我国政府权力清单制度法制化的主要原因有以下几个方面:第一,政府权力清单制度自身定位不明确,在学界存在很大争议。第二,权力清单制度的运行缺乏统一性,各地区行政机关对于权力清单的分类方式、各自权力清单所囊括的事项标准不一、差异甚大。第三,权力清单制度推行以来,僭越法律的现象时有发生。第四,权力清单制度成为行政机关扩大权力的避风港。第五,权力清单制度的配套监督设施不完善,权力清单从形成的各个环节到公布以后的具体落实都缺乏有效的监管机制,也缺少权力清单的动态监管程序规范。第六,行政机关公职人员的综合素质较低且缺乏责任意识。针对以上六个方面的问题,笔者提出了下列几项措施:第一,明晰政府权力清单的定位,政府权力清单的定位应偏向于行政法规。第二,统一权力清单内容的分类标准,要坚持把法律法规作为政府权力清单分类的唯一标准。第三,健全权力清单制度的相关法律法规,以法律条文的方式规定制定权力清单制度的流程和方式。第四,建立系统的行政权限规范体系,杜绝行政机关越权、滥权的现象。第五,完善权力清单配套的监督机制,包括行政机关内部自上而下的监督、国家权力机关的监督、社会公众的监督和法律的监督。最后,要大力提高公职人员的综合素质和责任意识,使公职人员真正成为人民的公仆,以全心全意为人民服务为要旨,走出以前重权力、轻权力和重实体、轻程序的观念误区,树立程序规范,真正做到权为民所用、情为民所系、利为民所谋。希望通过本文对权力清单的研究,推动相关部门对权力清单制度重要的认识。将权力清单制度看作是深化简政放权工作的一种途径,为加快形成边界清晰、权责一致、运转高效的政府职能体系和科学有效的权力监督、制约提供积极努力,从而全面推进依法行政。
[Abstract]:In March 2015, the General Office of the CPC Central Committee and the General Office of the State Council jointly issued the guidance on the implementation of the list of powers system for local government departments at all levels, which clearly stated that The implementation of the government power list system is an important aspect of the modernization of our country's governance system and governance capacity, and it is clearly put forward that by the end of 2015, the provincial governments should complete the announcement of the administrative power. In the process of combing the list of powers, the author combs and summarizes the legal problems exposed in the implementation of the system of the list of powers of our government. This paper puts forward the main problems in the legalization of the power list system of our government, and puts forward the corresponding countermeasures on how to promote the legalization of the power list system more effectively. This paper holds that the main reasons for restricting the legalization of the government power list system are as follows: first, the position of the government power list system itself is not clear, and there is a lot of controversy in academic circles. Second, the operation of the power list system is lack of unity, the regional administrative organs of the list of powers of the classification, the list of powers included in their own standards, very different. Third, since the implementation of the list of powers system, the phenomenon of illegal violation of the law has occurred from time to time. Fourthly, the list of powers system has become a safe haven for administrative organs to expand their power. Fifth, the power list system of supporting supervision facilities are not perfect, the list of power from the formation of each link to the specific implementation after the publication of the lack of effective regulatory mechanisms, also lack of dynamic regulatory procedures of the list of powers norms. Sixth, the comprehensive quality of public officials in administrative organs is low and lack of sense of responsibility. In view of the above six problems, the author puts forward the following measures: first, to clarify the positioning of the government power list, the positioning of the government power list should be biased towards the administrative laws and regulations. Second, to unify the classification standard of the power list, we should insist on the laws and regulations as the only standard for the classification of the government power list. Third, perfect the relevant laws and regulations of the power list system, and stipulate the process and method of making the power list system in the way of law. Fourth, the establishment of a system of administrative authority norms system, to stop the phenomenon of excessive authority, abuse of power. Fifthly, we should perfect the supervision mechanism of the power list, including the top-down supervision within the administrative organ, the supervision of the state power organ, the supervision of the public and the supervision of the law. Finally, we should make great efforts to improve the comprehensive quality and sense of responsibility of public officials, make public officials truly become public servants of the people, take serving the people wholeheartedly as their main purpose, and step out of the misconception of attaching importance to power, power and substance, and neglecting procedure. Set up procedural norms, truly achieve the right for the people to use, feelings for the people, benefit for the people. It is hoped that through the study of the list of powers in this paper, the relevant departments will have an important understanding of the power list system. The system of list of powers is regarded as a way to deepen the work of decentralization, which provides positive efforts to accelerate the formation of a government functional system with clear boundaries, consistent powers and responsibilities, efficient functioning, scientific and effective power supervision and restriction.
