政策进入法律的技术分析

【摘要】：随着政府工作职能的转变，传统意义上的政策治理模式已经不能在处于社会转型期的中国得到合法性证成，执政党要想继续执政必须重新考虑政策与法律的关系，使政策和法律二元格局往更加和谐的方向发展。运用法律进行社会治理是新时期执政者继续执政的合法性途径，，也是其保持执政地位的必要手段。而在将政策转化为法律的过程中，立法技术理论的不完善、具体立法技术的缺乏导致很多政策转化为法律后缺少可操作性，并且一批不该转化为法律的政策也堂而皇之地进入了法律的范畴，更加削弱了法律的权威性和人们对法律的信任感。因此，必须对政策进入法律的立法技术中尚有缺漏的重要部分进行详细的分析，唯有此才能实现法治，形成善治的社会。
[Abstract]:With the transformation of the government's work function, the traditional policy governance model can no longer be proved to be legitimate in China during the period of social transition. If the ruling party wants to continue to be in power, it must reconsider the relationship between the policy and the law. Make the dual pattern of policy and law develop in a more harmonious direction. The application of law to social governance is the legitimate way for the rulers to continue to govern in the new period, and is also the necessary means for them to maintain their ruling position. In the process of transforming policy into law, the imperfect theory of legislative technology and the lack of specific legislative technology lead to the lack of maneuverability after many policies are transformed into law. And a number of policies which should not be transformed into law have entered the scope of law, weakening the authority of law and people's trust in law. Therefore, it is necessary to make a detailed analysis of the important parts of the legislation technology in which the policy enters into the law, which is the only way to realize the rule of law and form a society of good governance.
