实践理性视阈下的环境法哲学体系

【摘要】：环境法作为新兴法律部门,尤其需要对其部门法哲学体系展开研究。环境法的生命力不在于单纯的"理论理性"及概念思辨,而是不断保持对现实世界的开放性与互动性;实践理性是环境法哲学的基本立场。实践面向的环境法学认识论,需要摆脱生态中心与人类中心、"主客一体"与"主客二分"的二元对立,通过可持续发展伦理观的履行实现人与自然的和谐共生。实践面向的环境法学价值论,需要在遵循"价值"和"法的价值"一般性原理的基础上,根据环境保护实践的需要,适当地对传统法律价值观予以突破和发展。
[Abstract]:As a new law department, environmental law needs to study its legal philosophy system. The vitality of environmental law lies not in pure "theoretical rationality" and conceptual speculation, but in keeping with the openness and interaction of the real world. Practical rationality is the basic position of environmental law philosophy. The epistemology of environmental law facing practice needs to get rid of the dual opposition between ecological center and human center, "subject and object" and "subject and object", and realize the harmonious symbiosis between man and nature through the implementation of ethics of sustainable development. On the basis of following the general principles of "value" and "value of law" and according to the needs of environmental protection practice, the value theory of environmental law facing practice should be properly broken through and developed.
