健全和完善我国转基因食品标识制度研究

【摘要】：上世纪末，转基因技术飞速发展并扩展到食品领域，由于现有技术手段无法明确转基因给人类带来的风险，因此对转基因食品添加标识成为国际社会的主流趋势。笔者认为，在转基因技术发展的同时应特别注意食品安全的监管，从风险预防与保护消费者权益的角度对转基因食品实行强制标识，通过明确专项法规和具体标识规范内容来健全和完善我国的转基因食品标识制度。第一部分论述了本文的选题背景和研究意义，并说明了具体的研究内容和研究方法。第二部分对转基因食品及食品标识制度的概念进行了论述，用明确的数据阐述了当前转基因农作物的发展现状，分析了转基因食品的安全性，并从维护消费者知情权和安全权的层面论述了食品标识制度的意义。第三部分主要围绕我国的转基因食品标识制度，从立法现状、运行现状和消费者对转基因食品的认知现状等方面进行具体梳理分析，根据现实情况总结了我国转基因食品标识制度存在的突出问题，如缺少专门法规调整，监管主体不明确等，，并对突出问题进行了具体分析说明。第四部分介绍了部分发达国家对转基因食品标识的具体规范，以美国、欧盟和日本为例，通过阐述基本原则、监管主体和具体法律规范，希望给我国的转基因食品标识制度以启示和借鉴。第五部分则为健全和完善我国的转基因食品标识制度提出了具体建议，建议制定相关的专门法规和管理办法，明确基本原则、监管主体和具体标识规范，并建立救济制度和召回制度为其配套措施。
[Abstract]:At the end of last century, transgenic technology developed rapidly and extended to the field of food. Because the existing technology can not make clear the risk of transgenic food to human beings, it has become the mainstream trend of the international community to label genetically modified food. The author thinks that while GMO technology is developing, special attention should be paid to the supervision of food safety, and from the angle of risk prevention and protection of consumers' rights and interests, the GMFs should be subject to mandatory labeling. In order to perfect and perfect the labeling system of transgenic food in China, we should clarify the specific laws and regulations and the specific labeling norms. The first part discusses the background and significance of this paper, and explains the specific research content and research methods. In the second part, the concept of GM food and food labeling system is discussed, and the current situation of GM crops is expounded with clear data, and the safety of GM food is analyzed. The significance of food labeling system is discussed from the aspect of protecting consumers' right to know and safety. The third part mainly focuses on China's GM food labeling system, from the legislative status, operational status and consumer awareness of GM food specific analysis of the status quo. According to the actual situation, this paper summarizes the outstanding problems in the labeling system of genetically modified food in China, such as the lack of special regulation adjustment, the unclear supervision body and so on, and makes a concrete analysis and explanation of the outstanding problems. The fourth part introduces the specific norms of GM food labeling in some developed countries, taking the United States, the European Union and Japan as examples, through the elaboration of the basic principles, regulatory bodies and specific legal norms. It is hoped to enlighten and draw lessons from the labeling system of genetically modified food in China. The fifth part puts forward concrete suggestions for perfecting and perfecting the labelling system of genetically modified food in China, and suggests to formulate relevant special laws and regulations and management methods, to clarify the basic principles, to supervise the subject and to specify the specific labeling standards. And the establishment of relief system and recall system for its supporting measures.
