我国农村集体经济组织的角色扭曲与社会变革背景下的立法重构

【摘要】：我国农村集体经济组织建立之初,在经济职能之外就肩负着建立公有制、提供公共产品、保障成员生存等政治职能,各种职能之间的冲突导致其在主体角色定位与运行上陷入混乱。不过农村集体经济组织是目前管理农民集体财产、维护集体成员权益较为合适的机构,不应被抛弃。在农村社会变革的背景下,农村集体经济组织应被改造为自我管理的纯粹经济组织,依据市场规则建立主体运行制度,并按照财产权规则重构成员权制度。
[Abstract]:At the beginning of the establishment of rural collective economic organizations in China, they were shouldering the political functions of establishing public ownership, providing public goods, ensuring the survival of members, and so on, in addition to their economic functions. The conflicts between various functions lead to confusion in the orientation and operation of the main role. However, the rural collective economic organization is the appropriate organization to manage the peasants' collective property and safeguard the rights and interests of the collective members, and should not be abandoned. Under the background of rural social transformation, rural collective economic organizations should be transformed into self-managed pure economic organizations, establish the main operating system according to the market rules, and reconstruct the membership rights system according to the property rights rules.
