出租汽车行政许可制度研究

【摘要】：随着我国经济发展进入快车道，人们生活水平越来越高，居民的个性化出行也越来越突出，适应这一需求的出租汽车运输方式迎来了行业的大发展。据统计，至2013年底全国共有出租汽车120余万辆，年完成客运量370多亿人次，约占城市客运量的30%。近些年，我国大中城市经常出现出租汽车驾驶员群体性事件，引起了社会各界的关注。本文通过对出租汽车行政许可制度的法理考察，结合国内出租汽车许可制度的现状，对我国出租汽车行政许可制度存在的主要问题及原因进行分析，剖析了出租汽车行业在当今社会经济深刻发展变化的背景下，完善和发展出租汽车行政许可制度的必要性。同时，借鉴国内出租汽车行政许可制度改革发展的经验，提出了我国出租汽车行政许可制度构建的总体方案构想。本文以文献研究和实证调研方式为主，研究的主要成果包括两个方面：第一，就是从出租汽车行政许可的角度分析出租汽车行业存在的问题、成因，及这些问题与许可制度设计的关系。二是提出出租汽车行政许可制度的完善建议，指出在完善出租汽车行政许可体制上，，应实现政府权力的有效配置和职能转变；通过立法建立统一出租汽车许可制度，明确许可项目、条件和程序；构建出租汽车行政许可的双轨制；建立附条件的出租汽车行政许可制度，完善出租汽车许可配套制度，以期实现对出租汽车市场的有效调控，达到完善出租汽车行政许可制度的目标。
[Abstract]:With the rapid development of our country's economy, people's living standard is getting higher and higher, and the individualized travel of residents is more and more prominent. The taxi transportation mode which adapts to this demand has ushered in the great development of the industry. According to statistics, by the end of 2013, there were more than 1.2 million taxis nationwide, with an annual passenger volume of more than 370 billion, accounting for about 30 percent of the city's passenger traffic. In recent years, taxi drivers' mass incidents often occur in large and medium cities of our country, which has aroused the attention of all walks of life. This paper analyzes the main problems and reasons of the taxi administrative license system in our country by examining the legal principle of the taxi administrative license system and combining the present situation of the domestic taxi license system. This paper analyzes the necessity of perfecting and developing the administrative license system of taxi under the background of the profound development and change of social economy in the taxi industry. At the same time, drawing lessons from the experience of the reform and development of the domestic taxi administrative license system, this paper puts forward the overall scheme of the construction of the taxi administrative license system in China. This paper mainly focuses on literature research and empirical research, the main research results include two aspects: first, from the perspective of taxi administrative licensing analysis of taxi industry problems, causes, And the relationship between these problems and the design of licensing system. The second is to put forward the suggestion of perfecting the system of taxi administrative license, pointing out that the effective allocation and function transformation of government power should be realized in perfecting the system of taxi administrative license, and establishing the unified taxi license system through legislation. Make clear the license project, condition and procedure, construct the double track system of taxi administrative license, establish the conditional taxi administrative license system, perfect the supporting system of taxi license, in order to realize the effective regulation and control to the taxi market, To achieve the goal of perfecting the taxi administrative license system.
