综合的反恐体系及检讨——以法国“新反恐法”为中心

【摘要】：时下,法国正面临二战后最严重的恐怖主义威胁。奥朗德总统被迫四度延长全国紧急状态,朝野共同商讨有效的反恐对策,尝试建立综合的反恐体系。"新反恐法"便是这一背景下出台,目的是"在紧急状态下所确立的司法框架之外","持久地强化行政机构及司法机构所可使用的手段与方式"。在内容上,"新反恐法"引入了多种反恐侦查及预防手段,涉及刑法、刑事诉讼、财政管控等诸多领域,强化了对恐怖犯罪的刑事打击,并尝试从源头上切断恐怖活动的资金来源。但一套精心设计的综合反恐体系依然面临诸多挑战,仍有进一步完善的空间。
[Abstract]:France is facing its worst terrorist threat since World War II. President Hollande has been forced to extend the state of emergency for four times, to discuss effective counterterrorism measures and to try to establish a comprehensive counter-terrorism system. " The new Anti-Terrorism Act was enacted against this background with the aim of "beyond the judicial framework established in a state of emergency" and "to strengthen permanently the means and means available to the executive and the judiciary". In terms of content, the "New Anti-Terrorism Law" introduces a variety of anti-terrorist investigation and prevention measures, involving criminal law, criminal proceedings, financial control and other fields, and strengthens the criminal crackdown on terrorist crimes. And try to cut off the sources of financing for terrorist activities at the source. But a well-designed comprehensive anti-terrorism system still faces many challenges and there is room for further improvement.
