警察权的现代功能与宪法构造难题

【摘要】：在现代社会,警察权仍是国家的强制力量,但还作为纪律机制承载个体规训功能,作为兜底秩序承担执法衔接功能,作为紧急权力促进秩序的常规化切换。然而,在现代社会的宪法权力体制中,警察权隐蔽在行政权之后,并未明确地予以标示。这就与警察权在现代社会秩序维系中的实践功能形成一定的张力。这一张力为警察权的宪法构造提出了诸多平衡难题。所谓"警察权滥用"不过是这一张力关系的话语转述,只不过带有明显的偏向,它忽视了警察权为实现其功能而可能对宪法限制框架的超越。中国宪法的警察权构造同样面临这一难题,具体表现为侦查中心主义对公检法关系结构的异化、刑事侦查与公安行政权的交叉错位、紧急权力的去宪法化。应立足于警察权宪法构造的一般框架,在宪法体制的整体视角下,通过宪法解释与配套宪法制度的构建,来尝试化解警察权功能与警察权超越宪法构造的两难,从而走出因限制警察权而使其功能随之受到抑制的偏颇误区。
[Abstract]:In modern society, the police power is still the compulsory force of the country, but also as a disciplinary mechanism to carry the individual discipline function, as the bottom of the order to assume the function of law enforcement convergence, as emergency power to promote the regular switching of order. However, in the constitutional power system of modern society, the police power is hidden behind the administrative power and is not clearly marked. This forms certain tension with the practical function of police power in the maintenance of modern social order. This tension raises a number of balancing problems for the constitutional structure of police power. The so-called "abuse of police power" is only the discourse of this tension relationship, but with a clear bias, it ignores the police power in order to achieve its function and may exceed the framework of constitutional restrictions. The constitution of the police power in China also faces this difficult problem, which is manifested in the alienation of the relationship structure among the public security bureau, the procuratorate and the court, the cross-dislocation of the criminal investigation and the administrative power of the public security, and the dematerialization of the emergency power. It should be based on the general framework of the constitution structure of the police power, under the overall angle of view of the constitutional system, try to resolve the dilemma between the function of the police power and the transcendence of the constitution structure through the constitutional interpretation and the construction of the supporting constitutional system. In order to limit the power of the police and make its function suppressed by the biased error.
