食品安全重大事故处理公众参与制度研究

【摘要】：如今食品安全事故频发,当发生重大食品安全事故时,对于事故的处理公众参与的热情很高,但是由于现实种种原因公众的参与程度并不高,主要原因表现在我国《食品安全法》对公众参与表达和监督权的立法不足；事故处理的中监管部门职能未能厘清并导致问责缺失；事故应急预案中公众参与的程度不足；事故处理对我国城乡二元结构差异性考虑不足；事故后期处置缺乏公益诉讼机制保障以及存在的其他原因。因此完善公众参与制度对于处理食品安全重大事故有着不可或缺的重要意义,在食品安全监管和重大事故处理方面,从立法到执法,再到司法环节,应建立公众参与制度。立法环节完善公众参与食品安全重大事故处理的相关法律保障,完善《食品安全法》关于重大事故处理参与主体规定并建立对举报者的特别法律保护制度；执法环节明确政府职责,提高执法技术和事故处理水平；司法环节实现事故处理与公益诉讼制度的衔接；最后建立公众参与食品安全重大事故处理的信息沟通机制并加强食品安全知识的宣传教育,这样会更有利于食品安全重大事故的处理,让社会公众参与监督,对于食品安全是个极大的保障,使得事故处理更加及时、高效、透明。
[Abstract]:Nowadays, food safety accidents occur frequently. When major food safety accidents occur, the enthusiasm for dealing with the accidents is very high, but the degree of public participation is not high because of various practical reasons. The main reason is that the legislation of "Food Safety Law" on public participation and supervision is insufficient; The regulatory function of accident management failed to clarify and lead to lack of accountability; the degree of public participation in accident emergency plan was insufficient; the difference of dual structure between urban and rural areas was not considered enough in accident handling; The late disposal of the accident lacks the protection of public interest litigation mechanism and other reasons. Therefore, improving the system of public participation plays an indispensable role in dealing with major food safety accidents. In the aspect of food safety supervision and handling of major accidents, from legislation to law enforcement to judicial links, the system of public participation should be established. The legislation link consummates the public to participate in the food safety major accident processing related law safeguard, consummates the food safety law regarding the major accident handling participation main body stipulation and establishes the special legal protection system to the whistleblower; The law enforcement links clarify the government's responsibilities, improve the law enforcement technology and the level of accident handling, and realize the connection between the accident handling and the public interest litigation system in the judicial link; Finally, the establishment of information communication mechanism for public participation in the handling of major food safety accidents and the strengthening of propaganda and education on food safety knowledge will be more conducive to the handling of major food safety accidents and the participation of the public in supervision. Food safety is a great guarantee, making accident handling more timely, efficient, transparent.
