市场失灵视角下互联网专车监管制度的构建

【摘要】：专车在技术、服务方式、车辆供给方式、评价机制等方面实现了重大创新,突破了出租车的构成要件,可定性为交通运输网络车辆。专车可实现满足乘客多元出行需求、促进共享经济发展、提高管理效率、节能减排等社会经济价值。专车的市场失灵表现不同于出租车,除公共安全风险难以避免外,过度竞争、信息不对称、负外部性等均可自行避免。基于此,建议对专车构建不同于出租车的监管架构,确立安全—效率—秩序相平衡的监管目标和放松监管理念下的协同监管路径,采取放宽市场准入、设立新型牌照许可,取消数量与价格管制,实施商业合同式的人事管理制度及建立适当的安全机制等监管措施,明确监管主体的监管责任。
[Abstract]:The special car has achieved great innovation in technology, service mode, vehicle supply mode, evaluation mechanism and so on. It has broken through the composing elements of taxi, and can be defined as transportation network vehicle.The special bus can meet the needs of passengers, promote the development of shared economy, improve the efficiency of management, save energy and reduce emissions, and so on.The market failure of the special bus is different from that of the taxi. Besides the risk of public safety, excessive competition, information asymmetry and negative externality can be avoided by itself.Based on this, it is suggested to construct a regulatory framework different from that of taxis, to establish the goal of balancing safety, efficiency and order, to establish a cooperative supervision path under the concept of deregulation, to relax market access, and to establish a new license plate.It is necessary to abolish the quantity and price control, implement the personnel management system of commercial contract and establish appropriate safety mechanism, so as to clarify the supervisory responsibility of the subject.
