广州市质量技术监督打假治劣的现状与对策研究

【摘要】：在国家不断对质量技术监督系统进行强化执法的大背景下,广州市质量技术监督部门近年来不断加强执法力度,执法环境也在不断改善,但在具体执法实践中仍存在着一些问题与困境：假冒伪劣新态势、新特征不断涌现,监督执业人员结构发展不平衡,监督管理存在缺位,执法部门职责不清,处罚力度较弱等。本文主要依据政府管理理论、新公共服务理论和新公共管理理论,针对广州市质量技术监督打假治劣的现状及存在的问题进行深入的分析研究,从监督管理机制、法治建设、执业人员结构配置、产品标准的设立、产品质量监督抽查的效力、诚信体系的建设等方面探讨目前广州市质量技术监督打假治劣困境产生的深层原因。根据广州市质量技术监督打假治劣困境产生的原因,对比国外一些发达国家有关质量技术监督行政执法方面的先进经验,从完善监督管理机制、加强法律体系建设、提高执业人员素质、建立科学的质量标准体系、完善产品抽查制度、加快诚信体系建设等方面提出了完善广州市质量技术监督打假治劣的对策建议,以解决广州市目前所面临的质量技术监督打假治劣的难题。
[Abstract]:Against the background of the state's continuous efforts to strengthen the law enforcement of the quality and technology supervision system, the quality and technical supervision department of Guangzhou has continuously strengthened its law enforcement efforts in recent years, and the law enforcement environment has also been continuously improved. However, there are still some problems and difficulties in the practice of law enforcement: fake and shoddy new situation, new features emerge constantly, the structure of supervision practitioners is not balanced, supervision and management is absent, the responsibilities of law enforcement departments are not clear, and punishment is weak, and so on. Based on the theory of government management, the theory of new public service and the theory of new public management, this paper makes a deep analysis and research on the current situation and existing problems of quality and technical supervision in Guangzhou, from the supervision and management mechanism, the construction of rule of law. This paper probes into the deep causes of the difficult position of quality and technical supervision in Guangzhou at present from the aspects of the configuration of professional personnel, the establishment of product standard, the effectiveness of product quality supervision and spot check, the construction of credit system, and so on. According to the causes of the difficult situation of quality and technology supervision in Guangzhou, comparing with the advanced experience of some developed countries in quality and technology supervision and administrative law enforcement, we should improve the supervision and management mechanism and strengthen the construction of the legal system. In order to improve the quality of practitioners, establish a scientific quality standard system, perfect the system of product spot check, and speed up the construction of credit system, this paper puts forward some countermeasures and suggestions for perfecting quality and technical supervision in Guangzhou.
