江苏省交通运输行政管理体制改革研究

【摘要】：2013年初,中共中央部署实施了新一轮机构改革和职能转变工作,明确指出“政府职能转变是深化行政体制改革的核心”,要求“加快形成权界清晰、分工合理、权责一致、运作高效、法治保障的机构职能体系”。2013年3月14日批准通过的《第十二届全国人民代表大会第一次会议关于国务院机构改革和职能转变方案的决定(草案)》明确将铁道部并入交通运输部,随着铁路管理职能的并入,交通运输部门的职能更加全面,涉及的业务工作面也更广,铁路也成为深化交通运输改革的重点领域。十八届三中全会对全面深化改革做出了系统部署,明确改革的总目标是完善和发展中国特色社会主义制度,推进国家治理体系和治理能力现代化,充分发挥市场的决定性作用和更好地发挥政府作用。交通运输业是我国国民经济的基础产业,也是推动我国国民经济和社会发展的先行军。江苏交通作为全国率先构建综合运输体系的省份,现行的分散、交叉的交通行政管理体制与新的行业发展形势和政府管理要求出现了许多不相适应的地方,制约了综合运输体系的发展和效率提升。江苏交通运输行政管理体制亟需按照十八大精神,以新一轮机构改革和职能转变为契机,从推进江苏交通运输治理能力现代化为切入点,以交通运输治理体系和治理能力存在的问题为视角,分析交通运输行政管理面临的形势,从交通运输现代治理体系建设、政策法规体系的完善、市场准入制度和退出机制分析、执法行为的规范化等方面提出新形势下加强和创新交通运输行政管理的政策建议。同时,以职能转变为核心,结合江苏交通运输行政管理体制特点,进一步明确江苏交通运输管理部门的职能定位和边界,加大简政放权力度,放宽市场准入条件,转变管理方式,进一步发挥市场在资源配置中的基础作用。
[Abstract]:In early 2013, the CPC Central Committee deployed and implemented a new round of institutional reform and functional transformation, which clearly pointed out that "the transformation of government functions is the core of deepening the reform of the administrative system", and called for "speeding up the formation of a clear, rational division of labor and consistent powers and responsibilities." Efficient operation, The decision (draft) of the first session of the 12th National people's Congress on the Plan for Institutional Reform and functional Transformation of the State Council, approved on March 14th 2013, explicitly merges the Ministry of Railways into the Ministry of Transport. With the integration of railway management functions, the functions of the transportation sector have become more comprehensive and the business working face involved has become more extensive. The third Plenary session of the 18 CPC Central Committee made a systematic plan for the overall deepening of the reform, and made it clear that the overall goal of the reform is to perfect and develop the socialist system with Chinese characteristics. To promote the modernization of the national governance system and governance capacity, to give full play to the decisive role of the market and to give better play to the role of the government. It is also a leading force in promoting the development of the national economy and society in China. As the first province in the country to build a comprehensive transportation system, Jiangsu Traffic is now decentralized. The intersecting traffic administration system, with the new industry development situation and the government management requirements, has appeared many places that are not suitable for each other. It restricts the development and efficiency of the integrated transportation system. Jiangsu traffic and transportation administration system needs to take a new round of institutional reform and function transformation as an opportunity according to the spirit of 18. From the point of view of promoting the modernization of transportation management capacity in Jiangsu Province, and from the angle of view of transportation governance system and the problems existing in the management of transportation, this paper analyzes the situation faced by traffic and transportation administration, and from the perspective of the construction of modern transportation governance system, The improvement of the system of policies and regulations, the analysis of market access system and withdrawal mechanism, the standardization of law enforcement, and so on, are put forward to strengthen and innovate the policy proposals of traffic and transportation administration in the new situation. At the same time, the core of this policy is the transformation of functions. According to the characteristics of Jiangsu traffic and transportation administration system, the function orientation and boundary of Jiangsu traffic and transportation management department should be further clarified, and the decentralization of power should be strengthened, the market access conditions should be relaxed, and the management mode should be changed. Further give play to the basic role of the market in the allocation of resources.
