【摘要】：布依族是贵州省的主要世居民族之一,千百年来,厚植于布依族传统法文化的环境习惯法对当地(生态)环境的保护起到了基础性的保护作用。从习惯法这一概念被提出,我国的学者就开始对布依族等多个少数民族的环境习惯法有所关注并进行了一定程度的研究与探讨,迄今为止产生了部分的研究成果。少数民族环境习惯法是习惯法中的重要组成部分,其中不仅包括人们对生态环境保护的认识以及相关的生态环境理论,还包括关于自然生态环境保护的主要内容。红枫湖周边地区的布依族环境习惯法通过宗教崇拜、风俗禁忌以及村规民约等的形式表现出来。贵州这个省份拥有着很多少数民族,少数民族习惯法的存在已成为了一种极具民族特色的文化现象,它不仅仅与社会上的其他文化现象密切相关,是一套具有地方性特色的法规,也与当地的历史文化传统、自然地理环境紧密相关,由此可见,习惯法的存在并不是孤立单一的。许多布依族村寨早就沿袭多年属于各自的一些习惯法民俗,并且产生了重要的法律作用。本硕士论文的研究对象是红枫湖周边地区布依族的环境习惯法。通过实地走访、文献研读等方法对红枫湖周边地区布依族的水资源保护习惯法、林木保护习惯法、寨容寨貌保护习惯法、野生动物保护习惯法的相关内容以及梳理红枫湖周边地区布依族民间环境保护习惯法的形成条件、形式渊源和现代嬗变以及当地布依族民间环境保护习惯法在现代生态文明语境下的立法价值、执法价值以及其他的法治价值进行了解、概括,再将该地区多个村寨的布依族环境习惯法研究的成果进行梳理和整合,了解学术界对布依族环境习惯法研究的现状,比对提炼出本论文需要进一步去研究和解决的具体法律问题,其中包括红枫湖周边布依族环境习惯法形成的自然条件、民族条件以及社会条件、形式渊源(包括宗教崇拜、风俗禁忌、村规民约三个方面)和当地布依族环境习惯法在形式渊源和内容上的嬗变以及当地布依族环境习惯法的生态立法价值、执法价值和其他法治价值等内容。这样不仅有利于拓展布依族习惯法研究的新领域,丰富布依族环境习惯法的研究成果,还能为国家法的完善和生态文明的促进提供有效可行的建议。在对红枫湖周边地区几个布依族村寨的调研过程中,我不得不对现代化农村建设的显著成效予以感叹,同时也感受到了少数民族的传统文化正在悄无声息的流失。新农村的建设、各城市区域的发展都让汉民族的文化一点点侵入布依族村寨,很多的习惯法内容已经被人们淡忘甚至逐渐消失,因此越来越多的学者意识到这一问题,纷纷对少数民族村寨进行调研,对珍贵的历史资料进行收集和归纳总结。
[Abstract]:Buyi is one of the major ethnic groups living in Guizhou Province. For thousands of years, the customary environmental law, which is rooted in the traditional legal culture of the Buyi people, has played a fundamental role in the protection of the local (ecological) environment. Chinese scholars began to pay close attention to the environmental customary law of many ethnic minorities, such as Buyi, and to a certain extent studied and discussed it. So far, part of the research results have been produced. The customary law of the minority environment is an important part of the customary law, which not only includes people's understanding of ecological environment protection and related ecological environment theory, It also includes the main contents on the protection of the natural ecological environment. The environmental customary law of the Buyi people in the surrounding areas of Hongfeng Lake is manifested through religious worship, customs taboos, and village rules and regulations. Guizhou province has many ethnic minorities. The existence of ethnic customary law has become a cultural phenomenon with national characteristics. It is not only closely related to other cultural phenomena in society, but also a set of laws and regulations with local characteristics and local historical and cultural traditions. The natural geographical environment is closely related, so it can be seen that the existence of customary law is not isolated and single. Many Buyi villages have long been following some of the customary law customs that belong to their own for many years. The research object of this master thesis is the environmental customary law of Buyi people in the surrounding area of Hongfeng Lake. Through field visits, literature study and other methods, the customary law of water resources protection of Buyi people in the surrounding area of Hongfeng Lake is studied. The customary law of forest protection, the customary law of protecting the appearance of the village, the customary law of wildlife protection and the formation conditions of the customary law on the protection of the folk environment of the Buyi people in the area around Hongfeng Lake, as well as the relevant contents of the customary law on the protection of wild animals. The formal origin and modern evolution, as well as the local Buyi folk environmental protection customary law in the context of modern ecological civilization in the context of legislative value, law enforcement value and other values of the rule of law are understood, summarized, Then combing and integrating the research results of Buyi's environmental customary law in several villages in this area, to understand the current situation of the research of Buyi's environmental customary law in academic circles. By comparing and refining the specific legal problems that need to be further studied and solved, including the natural conditions, ethnic conditions and social conditions, including the natural conditions, ethnic conditions and social conditions, which include the formation of the environmental customary law of Buyi nationality around Hongfeng Lake, and the formal origin (including religious worship). The evolution of the local Buyi environmental customary law in terms of its formal origin and content, and the ecological legislative value of the local Buyi environmental customary law. The value of law enforcement and other values of the rule of law are not only helpful to expand the new research field of the Buyi customary law, but also enrich the research results of the Buyi people's environmental customary law. It can also provide effective and feasible suggestions for the perfection of national laws and the promotion of ecological civilization. In the course of investigating several Buyi villages in the surrounding areas of Hongfeng Lake, I have to sigh at the remarkable achievements in the construction of modern rural areas. At the same time, they also felt that the traditional culture of the ethnic minorities was losing quietly. With the construction of the new countryside and the development of various urban areas, the culture of the Han nationality was gradually invading the Buyi villages. A lot of customary law content has been forgotten or even gradually disappeared, so more and more scholars have realized this problem, have conducted research on minority villages, collected and summarized precious historical data.
