公职人员利益冲突防治策略研究

【摘要】：由于近几年因公职人员利益冲突导致的职务犯罪不断增多,党和国家对公职人员利益冲突问题进行了一系列的探索,此问题得到了普遍关注。然而,现阶段我国公职人员利益冲突问题仍然比较严重,这直接造成了大量公职人员腐败事件。公职人员利益冲突是造成腐败的根本原因,如何在个人利益和公众利益之间做好取舍是公职人员面临的突出问题,本次论文的目的是探讨并找到防治公职人员利益冲突的方法和策略,进而减少因利益冲突防治不到位而造成的职务犯罪、腐败等严重后果。本文运用文献综述法和实证分析法对公职人员利益冲突防治进行了深度分析,从公职人员利益冲突的危害到利益冲突防治制度出现的主要问题都进行了研究,并借鉴国外公职人员利益冲突防治制度,对我国公职人员利益冲突防治制度存在的问题进行了探索。最后对此问题的解决措施进行了总结:一是在公职利益防治制度方面,监管机构应当适当加强对公职人员私人生活的监督;二是在公职利益冲突防治制度的实施方面,应当对公职人员的权利进行适当的约束,加大公职人员清正廉洁风气培养,弘扬公众利益优先的传统美德。
[Abstract]:Due to the increasing number of duty crimes caused by the conflict of interests of public officials in recent years, the Party and the state have carried out a series of explorations on the conflict of interests of public officials, which has received widespread attention.However, at present, the conflict of interests of public officials in China is still serious, which directly results in a large number of corruption incidents of public officials.The conflict of interests of public officials is the root cause of corruption. How to make a good choice between personal interests and public interests is a prominent problem faced by public officials.The purpose of this paper is to explore and find out the methods and strategies to prevent the conflicts of interests of public officials, and then to reduce the serious consequences such as job-related crimes and corruption caused by inadequate prevention and control of conflicts of interest.This paper makes a deep analysis on the prevention and treatment of conflicts of interest of public officials by means of literature review and empirical analysis, from the harm of conflicts of interest of public officials to the main problems in the system of prevention and control of conflicts of interest.The problems existing in the system of preventing and controlling the conflicts of interest of public officials in our country are explored by reference to the system of prevention and control of conflicts of interest of public officials abroad.Finally, the measures to solve this problem are summarized: first, in the system of prevention and control of public interests, the supervision agency should properly strengthen the supervision of the private life of public officials; second, in the implementation of the system of prevention and control of conflicts of interest of public officials,It is necessary to restrict the rights of public officials, strengthen the cultivation of honesty and integrity of public officials, and promote the traditional virtue of giving priority to the public interest.
