大连市行政投诉处理工作的问题与对策研究

【摘要】:当前时期,处理好行政投诉工作一直被当作社会稳定的减压阀,已经上升到塑造行政部门形象、营造经济发展环境、构建和谐社会的高度。但实际上,大连市建立行政投诉制度仅有几年的时间。大连市行政投诉中心自2007年3月挂牌成立以来,通过行政投诉网络的建立和投诉受理各项规章制度的不断完善,行政投诉工作已逐步走上正轨。在日常的行政投诉一线受理工作中,市民热线是政府直接面对公众与群众交流沟通的快速通道,通过热线可以受理群众反映的涉及在执行公共政策过程中出现的各种热点、难点问题,以及对政府提出的各种批评、建议。所以,研究如何准确把握群众反映的责任主体,问题的性质和分类,如何通过市民热线利用有限的社会资源化解政府在公众中的不利影响,对建设服务型社会显得尤为重要。本文首先对国内外行政投诉处理工作研究的发展及现状进行阐述。其次,结合大连市的实际情况,运用理论分析、历史考察、调查取证、比较研究等方法,分析大连市行政投诉处理工作中存在的依据地方性条例处理问题、多头投诉浪费资源、权力归属制度问题以及对二级网络单位约束力弱等诸多问题。通过对问题原因进行剖析,总结出大连市行政投诉处理工作还需进一步完善的结论。然后本文参照发达国家以及国内部分地区的先进工作经验,针对大连市行政投诉处理工作中存在的几项问题,提出具体的改进方案,并对其可行性进行论证。最后本文分别从加强法制建设、完善行政投诉主体、加强投诉平台建设及强化舆论监督等几个方面对大连市行政投诉处理工作提出相关建议。
[Abstract]:In the current period, handling administrative complaints has been regarded as a pressure relief valve for social stability, which has risen to the height of shaping the image of administrative departments, creating an environment for economic development, and building a harmonious society.But in fact, Dalian establishes administrative complaint system only a few years time.Since the establishment of Dalian Administrative Complaints Center in March 2007, through the establishment of administrative complaints network and the continuous improvement of the rules and regulations for accepting complaints, the work of administrative complaints has gradually been on the right track.In the daily work of accepting administrative complaints, the citizen hotline is a fast channel for the government to communicate directly with the public. Through the hotline, the public can accept all kinds of hot spots related to the implementation of public policies.Difficult issues, as well as various criticisms and suggestions to the government.Therefore, it is particularly important to study how to accurately grasp the responsibility of the masses, the nature and classification of the problems, and how to use the limited social resources to resolve the adverse effects of the government in the public.In this paper, the development and current situation of administrative complaint processing research at home and abroad are described.Secondly, combining with the actual situation in Dalian, using the methods of theoretical analysis, historical investigation, investigation and evidence collection, comparative study, etc., this paper analyzes the problems existing in the handling of administrative complaints in Dalian based on local regulations, and the waste of resources in many complaints.There are many problems such as the system of power attribution and the weak binding force on the second-level network unit.By analyzing the causes of the problems, the conclusion that Dalian administrative complaint handling needs to be further improved is summarized.Then, referring to the advanced working experience of developed countries and parts of China, this paper puts forward some concrete improvement schemes and demonstrates its feasibility in the light of several problems existing in the handling of administrative complaints in Dalian.Finally, this paper respectively from the strengthening of the legal system construction, improve the main body of administrative complaints, strengthen the construction of complaint platform and strengthen the supervision of public opinion and other aspects of Dalian administrative complaints handling work put forward relevant suggestions.
