维护农民工劳动权益的保障政策研究

【摘要】：我国现阶段恰逢社会转型时期,工业化浪潮铺天盖地席卷而来,大批劳动力从农村向城市集体迁徙,他们的进驻为拓展城市经济注入了各类新型元素,与此相对应,也产生许多亟待解决的问题,问题之一就是这个群体的身份在短期内无法得到明确定义,即传统体制暂且不能以最科学的方法使其充分融入到城市中来。农民工作为我国社会建设中的一个特殊群体,对其劳动权益维护的讨论一直以来就受到理论学界和实务界的普遍关注,希望通过不断改革完善政府的相应保障政策以推进农民工的劳动权益维护也成了发展社会主义市场经济的客观要求。当前,政府制定了一系列维护农民工合法权益的保障政策,对农民工的合法权益进行维护。但就实践情况来看,农民工劳动权益的政府保障在政策规定、政策决策、政策执行以及政策反馈评估几个方面仍然表现出明显的不足。政策规定的问题主要体现在没有针对农民工的全国性专门立法和规定、缺乏专门针对维护农民工劳动权益的保障险种、农民工与其他职工的社会保障标准尚不统一。政策决策过程的问题体现在参与决策的主体不够多元化、决策的风险预估能力有待加强、决策程序制度有待完善。政策的执行问题主要体现在各级政府间利益的博弈、政府政策执行过程务虚、执行者权责分配不均、政策执行的基层监督较少。政策反馈与评估的问题主要体现在对政策反馈及评估重要性认识不强、政策反馈及评估机制不健全、对政策反馈及评估结果不重视、政策评估系统缺乏相关法律配套。农民工劳动权益的维护需要社会各界的共同参与、共同协作和共同推进。但对于现代国家而言,政府及其政策理应成为维护农民工劳动权益的主导者、推动者和责任者。针对现阶段存在的问题,可以从以下方面对农民工的劳动权益维护政府保障政策予以优化:从调整政策的价值取向、完善政策及相关法律法规来对政策规定作出优化;政策制定过程从促进制定主体多元化、公开论证保障政策可行性、提高决策主体的决策能力以及规范政策决策程序,优化政策质量几方面进行完善;政策的执行情况从健全执行机制、明确部门权责划分、加强政策执行过程监督进行完善;政策的反馈与评估从采取多元化评估的方式并促进独立化的评估组织、行程制度化的评估程序并强调公开化的评估结果、构建对接式的反馈渠道并拓宽多样性的反馈形式进行完善。
[Abstract]:The present stage of our country coincides with the period of social transformation, the tide of industrialization is sweeping through, a large number of labors migrate from the countryside to the cities collectively. Their arrival has injected all kinds of new elements into the development of the urban economy, corresponding to this.One of the problems is that the identity of this group can not be clearly defined in the short term, that is, the traditional system can not be fully integrated into the city in the most scientific way for the time being.As a special group in the social construction of our country, the discussion on the protection of the labor rights and interests of migrant workers has been generally concerned by the academic and practical circles.It is hoped that it is an objective requirement to develop the socialist market economy to promote the labor rights and interests of migrant workers by constantly reforming and perfecting the corresponding safeguard policies of the government.At present, the government has formulated a series of safeguard policies to safeguard the legitimate rights and interests of migrant workers.However, in practice, the government protection of migrant workers' labor rights still shows obvious shortcomings in the aspects of policy regulation, policy decision, policy implementation and policy feedback evaluation.The problems of policy regulation are mainly reflected in the lack of national special legislation and regulations for migrant workers, the lack of special protection insurance for protecting the labor rights and interests of migrant workers, and the lack of unity of social security standards between migrant workers and other workers.The problems in the process of policy decision are that the main body involved in the decision is not diversified, the ability of risk estimation needs to be strengthened, and the system of decision-making procedure needs to be improved.The implementation of the policy is mainly reflected in the game of the interests of the governments at all levels, the process of government policy implementation is empty, the distribution of power and responsibility of the executors is uneven, and the grass-roots supervision of policy implementation is less.The main problems of policy feedback and evaluation are that the importance of policy feedback and evaluation is not well understood, the mechanism of policy feedback and evaluation is not perfect, the policy feedback and evaluation results are not paid attention to, and the policy evaluation system lacks relevant laws.The protection of migrant workers'labor rights and interests needs the joint participation, cooperation and promotion of all walks of life.However, for modern countries, the government and its policies should be the leaders, promoters and responders of protecting the labor rights and interests of migrant workers.In view of the problems existing in the present stage, we can optimize the government safeguard policy for the labor rights and interests of migrant workers from the following aspects: optimize the policy from the value orientation of the adjustment policy, perfect the policy and relevant laws and regulations;The process of policy making should be improved from the aspects of promoting the diversification of the main body of the policy making, openly demonstrating the feasibility of the policy, improving the decision-making ability of the decision-making body and standardizing the policy decision procedure, and optimizing the policy quality.Policy implementation from sound implementation mechanism, clear division of authority and responsibility, strengthen the policy implementation process oversight to improve; policy feedback and evaluation from the adoption of a pluralistic approach to evaluation and promote independent evaluation organizations,The evaluation procedure is institutionalized and the results of evaluation are emphasized. The feedback channels of docking type are constructed and the feedback forms of diversity are improved.
