国家治理体系视域中社会中介组织研究

【摘要】:“新常态”下的经济发展坐标赋予政府管理“新内涵”。党的十八大提出“国家治理”的概念,十八届三中全会提出“推进国家治理体系和治理能力现代化”,治理模式的转型换挡提速而又“蹄疾步稳”。虽然“国家治理体系”是个新提法,但学术界关于“治理”的讨论由来已久。作为与统治相对的概念,一般认为治理主体多元、强调分权、注重协同合作、讲究上下联动。治理架构于国家范畴之下成为“国家治理”。国家治理体系的重要标志是政府、市场、社会多元治理主体共同发挥作用。然而,新中国成立后的很长一段时间里我们以苏联为范,政府在经济社会管理中充当“全能选手”,市场治理的空间被严重压缩,社会治理的平台更是几乎完全关闭。改革开放以来,市场由资源配置的手段到资源配置的基础性作用,再到资源配置的决定性作用,“看不见的手”在治理中发挥着日益重要的作用。与此形成鲜明对比的是,社会中介组织仍处于弱势地位,在国家治理职能发挥上仍然长时间缺位。社会中介组织的充分发育是增强治理活力的重要杠杆,涵养着社会治理最基础的细胞。现实情况是,我国社会中介组织尚未能成为撬动治理活力的杠杆。一方面,新中国成立以来尤其是改革开放以来我国社会中介组织从无到有、由小到大,取得了较大发展成就。而硬币的另一面则是,目前我国很多社会中介组织存在诸如法律地位与权力边界模糊、监督管理与自我规制薄弱、发展规模与成熟程度不够、经营收费与职业道德失范以及与国家、市场间的关系较为传统等问题。究其原因,一是旧有观念贫乏社会中介组织的生长土壤,二是传统机制挤压社会中介组织的生存空间。因而,创新发展社会中介组织推动国家治理现代化,既是国家治理现代化的客观要求,也是社会中介组织自身发展的必然趋势。具体说来,就是要完善专业法律体系,理清权力边界;严格外在监督管理,强化自我规制;加快自身发展速度,实现组织优化;依法查处违法行为,维护道德规范;实现市场、政府、社会中介组织协同治理。
[Abstract]:Under the new normal, the coordinate of economic development endows the government with "new connotation".The 18th National Congress of the Party put forward the concept of "national governance", the third Plenary session of the 18th CPC Central Committee put forward "to promote the modernization of national governance system and governance ability", and the transformation of governance mode increased speed and "steady step by step".Although "national governance system" is a new formulation, academic circles about "governance" has a long history.As a concept relative to the rule, it is generally considered that the main body of governance is pluralistic, emphasizing the separation of powers, paying attention to the cooperative cooperation and paying attention to the linkage between the upper and lower levels.The governance structure is called "national governance" under the national category.The important symbol of national governance system is that the government, market and social pluralistic governance main body play a role together.However, for a long time after the founding of New China, we took the Soviet Union as a model. The government acted as an "all-around player" in economic and social management, and the space for market governance was severely compressed, and the platform for social governance was almost completely closed.Since the reform and opening up, the market from the means of resource allocation to the basic role of resource allocation, and then to the decisive role of resource allocation, "invisible hand" is playing an increasingly important role in governance.In contrast, social intermediary organizations are still in a weak position and still lack the function of national governance for a long time.The full development of social intermediary organizations is an important lever to strengthen the governance vitality, and preserves the most basic cells of social governance.The reality is that China's social intermediary organizations have not yet become leverage to leverage governance vitality.On the one hand, since the founding of New China, especially since the reform and opening up, China's social intermediary organizations from scratch, from small to large, has made great achievements.The other side of the coin is that, at present, many social intermediary organizations in China have such problems as blurred legal status and power boundary, weak supervision, management and self-regulation, and insufficient development scale and maturity.The relationship between operating fees and professional ethics and the relationship with the country and the market is more traditional and so on.The reasons are as follows: first, the growth soil of the poor social intermediary organizations, the other is the traditional mechanism squeezing the living space of the social intermediary organizations.Therefore, the innovation and development of social intermediary organizations to promote the modernization of national governance is not only the objective requirement of the modernization of national governance, but also the inevitable trend of the development of social intermediary organizations themselves.Specifically, it is necessary to perfect the professional legal system, clarify the power boundary, strictly supervise and manage externally, strengthen self-regulation, speed up the pace of self-development, realize organizational optimization, investigate and deal with illegal acts according to law, safeguard moral standards, and realize the market.The government, the social intermediary organization coordinates the governance.
