论我国公务员财产申报制度的完善

【摘要】：公务员财产申报制度作为“阳光法案”,是被各国公认的反腐利器。许多国家运用这一制度来预防与惩治腐败现象,通常将向有关机关进行财产申报确定为公务员的基本责任和义务。其中学界对公务员财产申报制度的概念有很多种解释,本文认为,公务员财产申报制度是指:“一定级别与特定范围内的国家公务人员,依照相关申报法律等规定向受理与审查部门如实汇报自己以及近亲属的财产情况,并接受公众监督的制度。”本文的研究对象财产申报的主体是限定在《公务员法》第十六条规定的领导职务公务员和特殊部门、敏感权力部门的公务员及其近亲属,而不是全部公务员。这部分公务员在各级国家行政机关具有组织、决策、指挥等权力职能,他们掌握着特殊的权力或特殊的资源,因此面临着腐败诱惑的机会更多,更易产生贪污腐败等问题。根据我国目前反腐的实际情况,为了满足社会公众对这部分特殊公务员财产公开的期盼,进一步完善公务员财产申报制度迫在眉睫。构建符合我国国情的公务员财产申报制度是本文研究的主要目的。目前,我国没有正式的法律来规定公务员财产申报制度,因此笔者希望从立法的角度来探索如何完善公务员财产申报制度,希望能出台一部正式的统一的《公务员财产申报法》来规范公务员的财产申报。本文一共有五大部分,第一部分是绪论,主要介绍的是选题的研究背景与意义,借鉴国内外的研究成果,锁定本文的研究思路与方法。第二部分是对我国公务员财产申报制度及推行此项制度的现状进行分析。第三部分是在已有理论与已有实践的基础上,梳理出我国目前关于公务员财产申报规定的缺陷,并分析其原因,为完善公务员财产申报制度提供经验。第四部分主要是介绍境外国家或地区关于公务员财产申报制度的各种模式,学习境外国家或地区成功的实践经验,并加以借鉴。最后一部分是文章的重点,主要是介绍如何从立法的角度来具体完善公务员财产申报制度。针对前文论述的各种问题,借鉴境外的成功经验,着重从立法理念、立法内容和具体程序等方面不断进行探索与完善,最终出台《公务员财产申报法》。
[Abstract]:Civil servant property declaration system as "Sunshine Act", is recognized by countries as an anti-corruption weapon. Many countries use this system to prevent and punish corruption, and it is usually the basic responsibility and obligation of civil servants to declare their property to the relevant authorities. There are many interpretations of the concept of civil servant property declaration system in academic circles. This paper holds that the civil servant property declaration system refers to: "A certain level and a specific scope of state public servants," In accordance with the relevant reporting laws and other provisions, to receive and examine the departments truthfully report the property of their own and close relatives, and accept public supervision of the system. " The object of this paper is the subject of property declaration, which is limited to civil servants and special departments in Article 16 of the Civil servants Law, civil servants in sensitive power departments and their close relatives, but not all civil servants. This part of the civil servants at all levels of state administrative organs have the organization, decision-making, command and other power functions, they have special power or special resources, so they face more opportunities for corruption temptation, more prone to corruption and other problems. According to the actual situation of anti-corruption in our country, it is urgent to further improve the property declaration system of civil servants in order to meet the public's expectation of the disclosure of the property of this part of special civil servants. It is the main purpose of this paper to construct the civil servant property declaration system in accordance with the national conditions of our country. At present, our country does not have the formal law to regulate the civil servant property declaration system, therefore the author hopes to explore how to perfect the civil servant property declaration system from the legislative angle. It is hoped that a unified civil servant property declaration law can be issued to regulate civil servants' property declaration. There are five parts in this paper. The first part is the introduction, which mainly introduces the research background and significance of the topic, draws lessons from the domestic and foreign research results, and locks the research ideas and methods of this paper. The second part is the analysis of the civil servant property declaration system and the implementation of this system. The third part is on the basis of the existing theory and practice, combing out the defects of the present civil servant property declaration regulation in our country, and analyzing its reasons, providing experience for perfecting the civil servant property declaration system. The fourth part mainly introduces the various models of civil servant property declaration system in foreign countries and regions, learns the successful practical experience of overseas countries or regions, and draws lessons from them. The last part is the focus of the article, mainly introduces how to improve the civil servant property declaration system from the angle of legislation. In view of all kinds of problems discussed above, this paper draws lessons from the successful experience of foreign countries, emphasizes on the exploration and perfection from the aspects of legislation idea, legislative content and concrete procedure, and finally comes out with the Civil servant property Declaration Law.
