论我国中央与地方事权配置的法治化

【摘要】:中央与地方的关系始终是国家政治经济的核心问题之一,而中央与地方的事权配置是其中的重要内容。它关系着国家的政治稳定、民族团结和经济繁荣发展,关系着社会效率和资源流向。特别是现在中国正处于发展关键期,中央与地方事权配置问题处理得当,就能有效发挥中央和地方的积极性,成为我国发展的助推剂,反之则反。因此,通过何种途径使我国中央与地方事权配置问题得到理性化地解决,成为我们急需研讨的课题。十八届三中全会提出的任何改革都要于法有据的指导思想,为中央与地方事权配置的关系问题指明了方向。本文从中央与地方事权配置法治化的视角出发来研究中央与地方关系问题,希望通过建立关于中央与地方之间各个层面的法律制度来规范二者行为,使其问题通过法治方法来解决。文章共分为四个部分:第一部分从中央与地方事权配置的内涵入手,继而对我国中央与地方事权配置类型进行分析,在此前提下,阐述了中央与地方事权配置法治化的必要性和基本原则等基本原理;第二部分着眼于中央与地方事权配置的异域经验样本,考虑到我国是单一制国家,着重就单一制集权模式和单一制分权模式进行考察,以期为我国中央与地方事权配置法治化提供有益借鉴;第三部分对我国中央与地方事权配置现状、存在的问题及其原因进行了详细分析。这是基于中国现实的考量,也是我国中央与地方事权配置法治化必须植根的土壤;第四部分针对我国实现中央与地方事权配置法治化的具体路径进行了深入地探究。主要从三个层面进行了论述:一是要更新观念,实现我国中央与地方之间从行政放权到法治分权的转变;二是要加强中央与地方事权配置的立法建设,主要从完善宪法和修改制定中央与地方专门法及相关法律两方面展开论述;三是对我国中央与地方事权配置的争端解决机制进行探究,指出要解决我国中央与地方事权配置中的冲突,除了利用具有预防功能的立法机制、高效便捷的行政解决机制外,还可以引入司法裁决机制,发挥司法权在中央与地方事权配置中的积极作用。本文认为中央与地方的事权配置问题只能通过法治化的途径才能得到更好地解决,因此,我们必须从国家法治的高度,采取得力举措,在中央与地方之间建立符合中国国情和民主政治发展要求的、有助于社会进步和生产力发展的新型中央与地方事权配置机制,使中央与地方关系朝着更加健康的方向发展。
[Abstract]:The relationship between central government and local government is always one of the core problems of national politics and economy, and the allocation of power between central and local government is an important content. It relates to national political stability, national unity and economic prosperity, social efficiency and resource flow. Especially now that China is in a critical period of development, if the allocation of the central and local authorities is properly handled, the initiative of the central and local authorities can be effectively brought into play and become a booster for the development of our country, and vice versa. Therefore, it is urgent for us to solve the problem of the allocation of central and local authority rationally through what way. Any reform proposed by the third Plenary session of the 18th CPC Central Committee should be based on the guiding ideology of law, pointing out the direction of the relationship between the central and local authorities. This paper studies the relationship between the central and local authorities from the perspective of legalization of the allocation of power between the central and the local authorities, hoping to standardize their behavior by establishing legal systems at various levels between the central and local authorities. Let its problem be solved by the rule of law. The article is divided into four parts: the first part starts with the connotation of the allocation of the central and local authorities, and then analyzes the types of the allocation of the central and local authorities in China. The second part focuses on the foreign experience samples of central and local administrative power allocation, considering that China is a unitary country. Focusing on the single centralized power model and the single decentralization mode, in order to provide useful reference for the allocation of the central and local administration of power, the third part of China's central and local power allocation status quo, The existing problems and their causes are analyzed in detail. This is based on the consideration of the reality of China, and is also the soil where the legalization of the central and local administrative power allocation must be rooted. The fourth part makes a deep research on the specific path of realizing the legalization of the central and local administrative power allocation in China. It is mainly discussed from three aspects: first, to renew the concept, to realize the transformation from administrative decentralization to the rule of law between the central and local governments; second, to strengthen the legislative construction of the allocation of the central and local administrative powers. It mainly discusses from the two aspects of perfecting the constitution and amending and formulating the special laws of the central and local governments as well as the relevant laws. Third, it probes into the dispute settlement mechanism of the allocation of the central and local administrative powers in China. It is pointed out that in order to solve the conflict between the central and local authorities, the judicial adjudication mechanism can be introduced in addition to the legislative mechanism with preventive function and the efficient and convenient administrative settlement mechanism. Give full play to the positive role of judicial power in the allocation of central and local administrative powers. This paper holds that the allocation of administrative power between the central and local governments can only be better solved by means of the rule of law. Therefore, we must take effective measures from the height of the rule of law in the country. The establishment of a new central and local power allocation mechanism between the central and local governments, which conforms to China's national conditions and the requirements of democratic political development and is conducive to social progress and the development of productive forces, will make the relationship between the central and local authorities develop in a more healthy direction.
