【摘要】：社会救助是社会保障发展史上最为久远的制度安排,是世界各国社会保障体系中不可缺少的重要组成部分。作为社会保障制度的基础性制度安排,社会救助旨在维护社会底线公平,保障弱势群体最低基本生活,因而被称为社会的“最后一道安全网”。改革开放以来,随着经济社会的快速发展,人权问题特别是公民的生存权问题越来越引起人们的关注和重视。建立完善的社会救助制度,一方面有利于保障公民的基本生存权利,另一方面也有利于维护整个社会的安全和稳定,社会救助是一项造福全体公民的伟大工程。近年来,中国社会救助制度建设取得了巨大成就,但现行社会救助制度尤其是其中的政府责任部分仍然存在一些问题：如政府对社会救助的价值理念存在偏差,社会救助政府责任范围不明确,社会救助立法工作明显滞后等问题。因此,在社会救助领域,责任政府的建设有待进一步的完善,这要求我们不能仅仅从理论上对我国社会救助中的政府责任进行研究,更重要的是不断地在制度创设上有所突破。有鉴于此.对我国社会救助中政府责任的有关理论和相关制度进行深入地研究和探讨,有着时代的必要性和现实的紧迫感。本文分为四个部分：第一部分首先对社会救助政府责任作了概述,分析了社会救助政府责任主体、内容以及后果,强调了政府作为社会救助主体的必然性,并详细分析了政府与社会力量在社会救助中的不同地位及相互关系。论文第二部分深入阐述了当前我国社会救助政府责任的现状,既有成果,也有问题,亟需完善。论文第三部分和第四部分分别从宏观和微观两个方面重点分析了政府在社会救助中的责任边界,从而对社会救助政府责任做了全面的界定。宏观层面,社会救助政府责任就是在坚持持与经济社会发展相适应以及公平优先、兼顾效率的原则的前提下,建立健全相关法律法规、体制机制。微观层面,具体分析了各级政府在社会救助中的责任划分,以及各级政府应当履行的具体行政责任,即财政责任、实施和监管责任、引导社会力量救助责任以及宣传指引责任等。笔者认为,政府在社会救助制度设计中应当占占据导责任,为妥善解决当前我国社会救助存在的一系列问题,政府应当有所作为。政府应当树立权利理念、以人为本理念、生存权与发展权兼顾的理念,认识到获得社会救助是公民的一项基本权利,只要是符合救助条件的人都应当享有这项权利。政府应当制定或推动制定相应的法律法规,完善我国的社会救助法律体系,使我国社会救助事业有法可依。同时,政府应当完善社会救助的相关运行机制,如社会救助与促进就业的互动机制、社会救助的城乡统筹机制、社会救助网络信息化系统和服务机制以及非物质性救助机制等,以促进社会救助事业的顺利进行。另外,在社会救助事业中,政府应充分发挥其职能,承担财政责任、实施和监管责任、引导社会力量救助责任和宣传指导责任。
[Abstract]:Social assistance is the most distant institutional arrangement in the history of social security. It is an indispensable part of the social security system of all countries in the world. As the basic institutional arrangement of the social security system, social assistance is designed to safeguard the fair of the social bottom line and guarantee the lowest basic life of the disadvantaged groups, so it is called the "last" of the society. Since the reform and opening up, with the rapid development of the economy and society, the problem of human rights, especially the right to subsistence of citizens, has attracted more and more attention and attention. The establishment of a perfect social assistance system is beneficial to the protection of the basic rights of the citizens, on the other hand, it is also beneficial to the maintenance of the security of the whole society and the security of the whole society. Stability, social assistance is a great project for the benefit of all citizens. In recent years, great achievements have been made in the construction of social assistance system in China. However, there are still some problems in the current social assistance system, especially in the part of the government responsibility, such as the government's deviation in the value concept of social assistance, and the scope of the social assistance government's responsibility. It is clear that the legislative work of social assistance is obviously lagging behind. Therefore, in the field of social assistance, the construction of the responsible government needs to be further improved. This requires that we can not only study the government responsibility in our social assistance in theory, but more importantly, make some breakthroughs in the establishment of the system. The relevant theories and relevant systems of the government's responsibility will be deeply studied and discussed, which have the necessity of the times and the urgency of the reality. This article is divided into four parts: the first part is the first part of a summary of the responsibility of the social assistance government, the main body of responsibility, the content and the consequences of the social assistance government, and the emphasis on the government as a society. In the second part of the paper, the second part of the paper has expounded the current situation of the responsibility of the social assistance government in our country, with both achievements and problems, which need to be perfected. The third and fourth parts of the thesis are from the macro and micro two, respectively. On the other hand, the responsibility boundary of the government in social assistance is analyzed, and the responsibility of the social assistance government is fully defined. At the macro level, the responsibility of the social assistance government is to establish and improve the relevant laws and regulations and the system mechanism before the principle of adhering to the economic and social development and the principle of fairness and efficiency. At the micro level, it analyzes the responsibility division of government at all levels in social assistance, and the specific administrative responsibilities that governments at all levels should perform, namely, financial responsibility, implementation and supervision responsibility, guiding the responsibility of social force assistance and the responsibility of publicity and guidance. In order to properly solve a series of problems existing in the current social assistance in China, the government should make a difference. The government should set up the concept of rights, the concept of "people-oriented", the concept of both the right to existence and the right to development, and realize that obtaining social assistance is a basic right of citizens, as long as those who are in conformity with the conditions of assistance should enjoy this right. We should formulate or promote the formulation of relevant laws and regulations, improve the legal system of social assistance in our country, and make the cause of social assistance in our country in accordance with the law. At the same time, the government should improve the relevant operating mechanism of social assistance, such as the interaction mechanism of social assistance and employment promotion, the urban and rural co-ordination mechanism of social assistance and the information system of social assistance network. In addition, in the cause of social assistance, the government should give full play to its functions, undertake financial responsibilities, carry out and supervise responsibility, guide the responsibility of social force assistance and propagate the responsibility in the social assistance.
